Hi,

Come someone give a little Guidance after arrival to the USA what are the steps

for immigration purposes. I understand the 90 days to marry, what other forms

I need to file and so on. She is on a K1 Fiance Visa.

You will wanna get her a SSN - print your I-94 and take her with her passport and visa to the nearest office.

As soon as you are married you file for AOS/EAD/AP - to get her the green card, employment permit and travel authorization. The guides on here are handy.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Welcome to the VJ forum.

After you marry her (you have 90 days from the date of her arrival) and you get the marriage certificate. She has to apply for AOS (Adjustment of Status). Also apply for EAD and AP together with your i-485 form so she can receive her work permit/travel document. That way she can work and travel abroad while AOs is pending.

EDIT: Total amount will be $1070 ($985 Form fee + $85 biometric fee).

No additional fee is required to also file for EAD and/or Advance Parole. You may file these forms together.

The fees are listed here > http://www.uscis.gov/i-485

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

There is no cutoff time to apply for AOS. However, she will be deportable during the period after the I-94 expires (at the end of 90 days) and before she applies for AOS.

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.
