Hi there,

We're still on the fence on whether we want go via Fiancee or spouse visa. We have been heavily leaning towards fiancee as it seems faster and for us, having me not working after I move to US is not a big deal and we don't mind where we get married. We just want to be together as soon as possible.

It seems from reading this forum (which we're so grateful for) that generally Fiancee is faster but I just heard from a family friend who went the spouse route that she got her green card within 4 months of filing her I-130. Also looking on the USCIS website, it seems I-130 is 5 months which is similar to I-129F so I'm now re-questioning whether fiancee is still faster than I-130.

First I've seen on one of the threads for I-129F, that so and so states gets processed in TSC and so and so states get processed in CSC. I couldn't find the same for I-130. Can someone tell me/point me if there's a way to figure out which processing centre we're mostly like to be at if we file I-130. (SO is in NY).

Secondly, how reliable is the processing time on USCIS and just wondering if USCIS has a website to see average processing times?

Adjustment of Status (AOS) Process from K1
20th November 2015: Filed AOS paperwork along with Employment Authorization Document (EAD) and Advanced Parole (AP) requests.

29th November 2015: electronic notifications (Email and text x3)

25th November 2015: NOA1 (date they received)
17th December 2015: early walk in biometrics appointment. (letter date: December 21).

29th December 2015: Case ready to be scheduled for interview
8th February 2016: Completed service request for EAD via USCIS phone call
16th February 2016:Checked online and EAD was approved (Date approved February 12th).

19th February 2016- Card has been mailed

20th February 2016- Card delivered

Current status: Waiting for AOS interview to be scheduled!

Timeline

NY state is being processed at the TSC center, a 6/7 month wait (could always be longer or even faster) and then add about 1-2months from noa2 until visa interview day.

When you come to the states you will do AOS and before getting work and travel permit it's a 3month ish wait.

I believe the cr1 (spouse visa) gives you the permits "same day as entering the states".

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I-130 is a bit of a spin the bottle. There is Nebraska, California, Vermont, National Benefits Center and maybe Texas occaasionally in there too. You don't know where it's going to go or how long it will take. The petition normally takes about 4-8 months then the NVC process takes about 2-5 months. Then you have the interview.

Do you live closer to Vancouver or Montreal?

Montreal is the only place where immigrant visas are given interviews but K1 go to both Vancouver and Montreal.
