I got denied for my green card, and my wife now wants to get divorce.

We have been married since 2012 and got GC interview in 2014, we got denied because my wife lives in MA, and I live in NYC. My lawyer fiele the reappeal to BiA, and we got denied again. The reason why I live in Nyc because I have been working in the restaurant here for 10yrs and Can provide better finance than in MA. But now she wants to get divorce . I need some good piece of advises, what should I do? Will I get deport right away?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Even in your own writing you are admitting that you chose better financial option in NY (over living together in MA).

In a true loving relationship, I don't think couple would live apart just to make few more bucks.

So it sounds like you guys were married on paper, but really didn't have normal marriage relationship.

And I can see her filing divorce because if you are not going to live together,

what's the point of getting married...so it sounds like the immigration officials

saw this clearly and denied your GC.

Please fill out your timeline so that we can clearly see your processing status.

OP, I must side with your spouse, you are wrong in what you are doing, as being with and helping support your wife emotionally, if not finical help, you could do better than this.

I want to be with my wife, not 3-4 states away from her.

I think you may have a problem.

Work it out if the issue is distance living, commute by train,

go home to MA Tues evenings, Thurs & Fri or Sat (if U work on Sat)

atch the 5am many do it from Ct MD DC even Buffalo everyday. it

worth saving the marriage buy a mthly pass...sleep on the train.

You can get an atty to appeal again at BIA but that may only fly if you

and wife start loving & proves it, you have 30 days to again re-open an

appeal BIA that means moving to MA asap....or it does seem you marry for gc

1. If your marriage was real, you can try to save it, gather more evidence and appeal at BIA again

2. Pack your stuff and leave the country.

If you pick option 1, you have a lot of work to do, the most important would be to move with your wife, catch up with her and win her back.

By the way if you don't have a lawyer, I suggest you get one asap.
