I'm 2 monts pregnant now, can that be problem for getting fiance visa?

Hello, my fiance sent a I-129F at November 27 2014 and we recived NOA1 a week later. Afther that we didn't recived any another letter from USCIS. I am now 2 months pregnant and i want to know if that can be a problem for getting fiance visa. Will I get visa by the time when baby is born or no? Did anyone had a similar expiriance?

You may receive it on time, but costwise and comfort wise it may be better to have the child in your country.

I think it's better to give birth at my country, but will i get visa for my child too or we will have to do all process again?

The child would be eligible for CRBA and US citizenship if the father meets the eligibility requirements. If he does not, NO you will not need to start the process over again.

As you live in NY and are being processed at the TSC, it is unlikely you will receive your visa in time.

No, being pregnant won't be a problem WRT getting the fiance visa. Unfortunately it won't matter one way or the other in regard to your petition's evaluation at the TSC. I know because I was/am a TSC filer and Elena (my beneficiary) was pregnant at the time I filed in September 2014 and we were approved April 2015. As others have mentioned, you will need to do the CRBA for your child, assuming that your child is born in your country, and not the USA. Although your expected due date is early December, there will be a cutoff point after which you really shouldn't fly, especially on a long international flight from Serbia, with connections (probably). That will be around the beginning of November at the latest and that assumes that everything goes well with your pregnancy and pre-natal care, AND that you feel up to a long journey. Serbia is showing a 39 day average wait at the moment and given the wait at the TSC that you still have remaining plus the average time you'll need to get through the NVC, it could make things tight. However there is still a possibility that you will receive your visa in time and that you can fly to the USA prior to the birth of your child; it may end up boiling down to a medical decision but that's to be seen of course.

If you do have your child in your country, then as for the CRBA process itself, no, it isn't a "long" ordeal. The biggest wait factor will be the wait for the child's US Passport to arrive at the embassy and be sent to you via some type of courier service. However I have heard stories of that happening in as little as a week. Those are unconfirmed stories at this point, so I am still planning on 3 weeks right now. We'll see. That said, the tall pole in the tent WRT the CRBA process is the preparation. Your fiance will need to do a LOT of preparation in this regard and it will be time consuming. Ask me how I know. ;-) And if he cannot be there in person to attend then you'll need a special document that has to be certified/notarized/whatever. I didn't bother with that, since I will definitely be present for the interview. And of course the sticky-wicky part of the CRBA is the physical presence requirement. Your fiance will be required to show an aggregate physical presence within the USA of 5 years prior to your child's birth. And there is no waiver for the physical presence requirement.

Anyway, you might check out the CRBA subforum for more information. Our CRBA appointment is this Thursday and I am keeping a blog thing going in there regarding our experience. A man who's beneficiary is from China did something similar. If your fiance isn't aware of CRBA, which I would doubt that he is, then point him in that direction. He'd be well-served to read through it, in addition to whatever is stated on your country's US Embassy website regarding CRBA.
