Kindly, clarify if I need to fill in these forms as well while dispatching a packet including I-130 and I-485: 1) I-864, Affidavit of Support 2) I-765, Application for Employment Authorization

OR these are sent later

Many Thanks

You are curently here in the US legally on a tourist visa which expires in 4.5 months. After that time you will be in the US illegally if you remain beyond the expiration date on your I-94--I would print out a copy of this for your records. You will file the I-130 and I485 per the guides here on VJ along with all supporting documentaition. Up to you whether you want to file the EAD and/or AP (advance parole), but since you cannot work on a tourisst visa your situation will remain the same except now you cannot leave and re-enter the US until you have AP or the GC as once you start this process the tourist visa is no longer valid for you to use for travel.

I think what she meant was that she is used a tourist visa to go to USA with intent of migrating, and that's considered visa fraud. Unless she went to visit and then changed her mind.
