So people cannot act incoherent and strange without being intoxicated? For all the officer knew at the time she could have been bipolar or on medication. He didn't know just because some people speculated it.

In this case the officer is trained and I am sure from reports and his observation she appeared drunk, and it seems she has been charged for DWI and/or maybe felony child endangerment.

So it appears he made the right call here.....

In that case, why do we have breathalyzers and DUI test?

Why have rights at all. If you break the law, you should just get shot in the face. No trail, no nothing, right?

You sound like you actually think for a living. Too bad others don't do the same.

I am sure test were performed at the station when she was being booked....

You do that before you slam someone to the ground and handcuff them.

Overweight, unattractive, and drunk, therefore "she got what she deserved" SMH

You left our her hair was dyed. hahahahaha

They either drew blood, or had her take a sobriety test or blow test and then she was charged, or she refused all test and she was charged at the police station, This is the way it works.

Did you see her refuse the test? Did you see him stick a needle in her arm for a test?

It doesn't matter. Being drunk does not mean a police officer gets to throw you to the ground and knock you out.

And you do know it is within your rights to refuse the test?

Either way, he shouldn't have done what he did. He was wrong.

Yes you can refuse the test, but then you automatically loose your Driver License until your court case.

The blood test I don't know for sure since they have mandatory blood withdraw on suspected DWI suspect in Texas on certain weekends and they don't need a judge court order.
