I-864 and I-864A and assets, interview is scheduled

OK here is the thing....We are using our assets to meet the income requirement for household of 3. My wife is using her cash assets (90% of requirement) and I am using my apprised real estate for the rest. All together we are way enough over the requirement.

She filled out form I-864 and also listed my assets (intending immigrant`s assets, according to the I-864 instructions)....

Today I received an instruction mail for my interview from the embassy where it will be. There is a part called "financial documents" where is written that I (an immigrant) should fill out form I-864A and submit evidence of my assets and that they received proof of my wife`s assets.

I have already done that with I-864, sent in all proofs such are apprised value,title deed, etc.....

According to I-864A`s instructions I shouldn`t fill out this form. Instructions under 12. say " if you are intending immigrant and have no accompanying dependents, then do not list your assets on this form. Instead, your assets must be listed on item 24 of form I-864 ".

PS. I did call the embassy and explain everything. At the end, the lady on the phone also wasn`t sure should I or shouldn`t I fill out I-864A.

Now I`m confused...

The thing with this process is that not even the people looking at the applications, answering questions and making decisions seems to know how it works. I don't know how many times I've been given wrong information and different information depending who I speak to.

Your asset should be on the petitioner's I-864 and nowhere else, you shouldn't fill out any AOS form yourself. However, since the embassy is requesting you to fill one out and since they are the last decision makers, I think you should just do what they say and bring them an i-864a with proof of your assets.

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received

Yeap...it makes sense what you said.

So the "household member" on part 1 is me and the sponsor is my wife. But how to fill out Q13 tabel? Do I list myself (name and DOB) there?

By reading the instructions, it says:

I guess maybe they are not counting the 90% of cash your spouse has. And maybe because you said you have household of 3, that 3rd person maybe is seen as a dependent by them? That would kind of fit within the first sentence.

But even if you fill the 864A, since you haven't worked in the US in the last 3 years, then you can't fill out the part 11. (Federal income tax information)

And you probably shouldn't fill the 9. (I am currently employed ...), because this income doesn't continue in the US, thus it is irrelevant?

MMmmm ya , i-864A is stupidly confusing indeed.

I'm wondering then, in order to completely avoid the 864 BS, the only solution is to make sure the sponsor has the 3X 125% poverty limit in savings?

Hmmm they said that they received proof of my wife's assets, so they should count it.

Also on form I-864 is clearly stated that I am the only immigrant.

I think they are confused as I am:)

I hope everything will clear out at the interview!

PS. I will fill out I-864A as they instructed me ( just to be on the safe side). For question about tax I will fill out N/A, and for current income "0"

I did it as you suggested me, filled out I-864A (as they requested) and brought it with me to the interview. They took it and they were satisfied with it.

So people, give them exactly what they want:)
