Enter in United States with tourist visa-risks????

Timeline

My sister just get married with a USA citizen outside of USA. Her husband ask her to come in USA using her tourist visa, and then apply for change of her status.

What are the risks? She can be returned by the airport?

I' ve read through Visa Journey that he needs to apply for IR-1/CR-1, but his lawyer suggest him that is the waste of time. He trust his lawyer more than is we normal! For me something seems wrong since he doesn't want to hear about IR-1/CR-1?

Any advise about risks please?

It is visa fraud to enter with a tourist visa with the intent on immigrating/ staying.

They need to file the CR-1 spousal visa; she can visit with her tourist visa while that is in process, but she cannot live or work in the USA.,

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Tourist visa is for visiting, not living or immigrating. Intentionally trying to use it as such is a heaping helping of visa fraud.

CR-1 is the correct way to go.

December 12th, 2013: Picked up marriage license.

How my sister can convince her husband to apply for CR-1?

I repeat, her husband is convinced that she can come with tourist visa and submit for visa and residence once she can arrived in USA.

From what I read, is a fraudulent way of applying for visa and residency.

But I can't evaluate the risk for my sister...

Get her to read the tourist visa rules, and show her husband.

Get her to tell her husband she does not want to do anything illegal, which may need up with her getting a lifetime ban from the USA.

My sister knows that this is the legal way and wants to do everything legal, I think he doesn't understand what are the risks or he doesn't think about my sister safe. They are arguing a lot on this subject:(

It's a shame because they really love, but these visa procedure overshadow their relationship.

I have no idea what she sill say on interview.

The point is, she wants to enter in usa legally and apply for visa legally, he thinks his lawyers advise him shortly and proper, but I ask, what are the risks to this "shortcut"?

Make sure they inform CBP of their plan when he attempts to enter.

He will then be returned to his country of origin.
