EAD suspended while AOS suspended?

Hi there,

I came on K1, got married and filed for AOS and EAD afterwards. The timeline for EAD is 3 months. For my AOS application, I already received (and answered) two REF's. The 90 days for the EAD are long over. Do they stop working on the EAD when they have questions about the AOS? Is that the reason it takes so long?

An RFE regarding I-485 should not affect a correctly filed I-765. Not sure if processing times have increased for EAD card. Maybe a call to talk to a "tier2" representative at U.S.C.I.S. can help you....would have been a good idea to have filed a I-131 with the package in case you need to travel outside U.S.A. for a emergency, its free also. Hope you receive EAD card any day now....

Most of EAD are approved right after RFEs are responded sufficiently so yes it does pause EAD processing.

the OP stated he received the RFE for the I-485, not the I-765, i have seen cases of people getting approvals and receiving combo cards while dealing with a I-485 RFE, with no delays or pauses.

An RFE stops the processing of the EAD. It can even re-set the clock depending on what the RFE was for.

We filed for AOS/EAD/AP, and received an RFE for the marriage certificate (because the one

from Indiana actually *says* "license", even though its the certificate.) and yes, it looks like that

did hold up the EAD/AP for a month or so... it just got approved.

So, it probably depends on what the RFE is for.

SEP-1994 First met! 12-16-14 POE PHILADELPHIA

05-25-14 Engaged (what took us so looooong!!!?) 12-19-14 MARRIAGE (SIMPLE)

06-19-14 I-129F packet sent to Lewisville Lockbox (USPS overnight) 01-05-15 I-485 (AOS/EAD/AP) package mailed out

06-20-14 USPS messed up, and had to re-route! 01-12-15 NOA text/email received for AOS/EAD/AP

06-23-14 I-129F packet received at Lockbox 02-03-15 Biometrics (Indianapolis)

06-23-14 NOA1 Notice Date (routed to CSC, yay!) 04-07-15 EAD and AP approved, card ordered

06-25-14 NOA1 text/email received 04-14-15 EAD/AP Combo Card received by certified mail.
