Since it isn't based on marriage to a USC you have to wait the 5 years from the day you became a legal resident, you can submit your application 90 days prior to the 5 year mark.

You have to be married for the entire 3 years of having your green card.

Divorce before then etc means you will have to wait the five years.

You're looking at 2018.

Okay,so if we don't divorce,i should be eligible by June/July,2016?

I don't know the full extent of applying for citizenship with the 3 year rule (as I'm not there yet), but I would assume you would have to prove that your marriage is working and not just to get early citizenship which is what it sounds like you want..

Thanks Cody, but according to the letter i personally wrote to them,i said the marriage is not working for me and i can't continue to live in abuse,,she's mismanaging my money on drugs and i also wrote it in the letter that i do not have intention to be back with her if she doesn't change,so i stated my mind clear, but was still approved without interview.

To get citizenship at the 3 year mark (of being married AND an lpr) you need to send relationship evidence like you did for your ROC.

If you have your 10 year card you can always apply at 5 years. If I become a citizen that is when I would do it because this relationship evidence thing sucks!

I am sorry you're going through that.

But in order to qualify for the three year citizenship benefit that marriage brings you have to be married and living with your partner for the entire three years.

In other words you have to have a relationship that's working.

Even if you are still married by then, you won't be able to submit evidence that you are still together and not separated due to the abuse.

It looks like you will have to wait the full five years.

Its important to note the condition that you have been both married to and living with the U.S. citizen for the entire three years. If, for example, you and your U.S. citizen spouse have separated, divorced, or merely started living in different cities, then you are no longer eligible to use this exception.

Since you mentioned some abuse, I was tying to see what I could find for you.

So give this a read and maybe it will give you an idea of what you might be able to do.

These police reports are going to "pop up" for sure, and you are going to have to prove a very good marriage, or you will have problems filing before the 5 year wait, because of the way you went through ROC.
