AOS K1 - is marriage certificate the same as marriage license? (and other Qs)

Hi dynm,

These are my answers to your questions;

1. A marriage license is a piece of paper that authorizes you to get married and a marriage certificate is a document that proves you are married. Like here in Arizona, before we got married, we went first at the Superior court and get our marriage license. This license is good for 12 months. During our marriage ceremony, the marriage certificate was signed by the judge (or a priest if it's in the Catholic Church) . We went there after a week to get a certified copy.

2. K1s were advised to report our marriage within 90 days. - this is part of K1 visa. We need to get married within 90 days as per rule of USCIS but this is reported or included in all the AOS forms that will be sent at Chicago lockbox. You don't report it online.

3. I reported my married name by using it in all my forms on AOS, EAD and AP. Since you will send a copy of your marriage certificate/license, that is proof for your name change.

Also i don't know if you can answer this but i posted this question here already but let me ask you,

With I-864 I understand I need to list down my husband 3 most recent Tax year, however my husband didn't file tax for 2013 as he was a full time student someone told me to just put $0 but the instruction says to provide written explanation and evidence as to why he didn't file tax, we called his school to obtain copy of his transcript and we couldn't get copy as he has balance so do we still need to provide written explanation and evidence? Do we need to declare his 3 most recent tax year or just the latest one?

Okay sure no problem. :) Based from what I read, yes it is true we need to list down our husband's 3 most recent tax year ( 2012- 2014 ). I know we had to declare it as per instruction on USCIS but they would definitely want to see the recent one which is more important. (2014). My husband actually had low income on the year 2012 so what we did is we provided a written explanation stating why he had low income because he is finishing too his last semester that time but we also attached his transcript. They received it and there's no problem with that as long as we have explanation for sure.

Hope my explanation and experience helps. :) I think any evidence and written explanation will do. :)

I just send in a photocopy of my I-12F NOA2. I believe we will just bring the original copy on the interview itself :)

We were thinking of Sending his transcript too but we can't get it unless he pay his balance. He has ID but it doesn't have the year. So i don't know what else show as evidence.

If I'm on your case, I will give a photocopy of his ID as well and written explanation that he is a full time student that time. :) Did he have any other evidence? To me, I think what's more important is the 2014 income tax. You can also give a copy of his 2011 income tax but it's optional. Add his W2s and recent paystubs as well when submitting your AOS.

I really want to help you with this but we can wait for other VJs too who have the same situation as yours. You can wait for their opinions too :) To me, just gather all evidences as you can, write written explanation on your husband being a full time student that year 2012 and provide the recent W2's and 6 months pay stubs of your husband. I think that would be fine. :)
