clarification on forms related to aos/ead

Hi, I am in the process of getting these forms filled in. Sorry if asked/answered before but I would like to be 200% certain on what to fill in/ pay/ send.

I have read the forum posts as well as the example forms.

1) form g325a - I as the K1 holder needs to fill this out, correct?

a)File number A ... what is this? same of alien registration number?
b)Alien registration number... this is one the k1 visa or on 1 of those NOAs, correct?
c) SSN..i can fill in if I get it in time of doing this application, correct?

2)form 864 - US citizen proof of support

a) part 2 "info on principal immigrant " .. that is me the k1 person. Address would be the US address since I am here, no?
b) alien registration number.. on k1 visa or on 1 of the NOAs
c) confused if there is a fee or not and if there is , when to pay it? checked the uscis site which led me to the Department of state site

d) evidence of eligibility..I am to send in marriage certificate; i194 record. However what exactly is the fiance(e) petition approvial notice ( that 1 of the NOA docs)? Does my fiancé ( US citizen) need to submit his divorce papers ?

e)filing fee for i485 is $985. Says additional fee for biometrics service fee is $85.. do I send that in now or when I am called for that?

I will answer a few. G325 is for the k1 holder. Your a number is on your noa2 which you need to send a copy with your paperwork. If your i94 is still good, you should have applied for a ss number and you can put it on your forms. The amount for filing is &1,079 for i485, i765 and i131

Only the adjustment applicant supplies a G-325A as a required supplement form for the I-485.

If you have an SSN at the time of filing, then put it. If you don't have one yet, then leave it blank.

Yes, current address in US will be used on the AOS forms.

No fee when filing the I-864 with the USCIS

I-94# is the Admission Record Number at the top.

Yes, place of last entry is your POE.

The I-129F petition approval notice, known on VJ as the NOA2.

Divorce decrees not needed for AOS.

Just to clarify:

The I-94# is NOT on your visa. You need to go to https://i94.cbp.dhs.gov/I94/request.html and request your electronic I-94.

On your I-94, the Admission Record # at the top is your I-94#.

I am not following you on Part 7 .. it tells me to explain how I qualify for Advanced Parole but you say no supplement is required.

As well ..do I answer any of the questions (1 - 4j) or do I not ? Only 1 I can think that I would have to answer is #1 (choose "more than one trip"??)

I read the instructions and there , to me anyways, is not much to go on (pg 8 of the instructions. Not sure which is applicable to me ... option A would be the closest and the only proof would be the I94? option C - how can I send copy of USCIS receipt that I file AOS when AOS is part of all of this??) I am confused.

No supplement is required because no reason is needed for applying for Advance Parole. You do not need a reason because you are an adjustment applicant. So you qualify on that alone.

The only thing you answer on part 7 is the first question which is MORE THAN ONE TRIP.

I understand the instructions can be quite confusing. To answer your question about the pg 8 instructions, you are an adjustment applicant filing for Advance Parole. You are looking at option C, number 3 (copy of USCIS receipt as evidence of filing). If you file your I-131 with the I-485, you do not need to include any USCIS receipt. You only need to include the NOA1 of your AOS if you file at a later date.

To further clarify things, the documents you need to include with the I-131 application are:

  • 2 passport photos
  • copy of bio page of your passport
  • copy of your K-1 visa

I hope this helps clear up some confusion.

You skip from the bottom of Page 2 to Part 7 on Page 4. You only check 'More than one trip' and leave the rest blank, like it shows in the example form here on VJ.

No explanation or reason is needed when filing the I-131 with a pending I-485 as an adjustment applicant. You would be c. on the instructions from Page 8.

See the OR between #2 and #3. If you are filing the I-131 with the I-485, then no need for the receipt. If filing the I-131 after the I-485, then a copy of the receipt notice from filing the I-485 is all you need.

c. Advance Parole Document

If you are in the United States, you must attach:

(1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and

(2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole

Document; or

(3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the

adjustment application

background. Head height should measure 1" to 1 3/8" from top of hair to bottom of chin, and eye height is

between 1 1/8" to 1 3/8" from bottom of photo. Your head must be bare unless you are wearing headwear as

required by a religious denomination of which you are a member. Using pencil or felt pen, lightly print your name

and A-Number on the back of the photo.

I will be sending in all at the same time so I presume all the required information ( such as passport biometric page/ 2 US sized passport pics ) would be valid for all forms that require such documents and that I don't have to send in for each form ? :-)

I forgot to ask about question 4a in part 3. In the sample, this was not answered . I would say that I would need to answer to this question .

I forgot to ask about question 4a in part 3. In the sample, this was not answered . I would say that I would need to answer to this question .

You need to send in the requirements for EACH application.

Question 4a in part 3 can be left blank if it does not apply to you...just like the example form.
