Got welcome email from NVC, Trying to do adjustment of status

If you file an I-485 before your accompanying I-130 priority date is current, it will be rejected by USCIS and returned to you.

11 years is a long time to be in F-1 status; you would need to have (and prove) you don't have a single day of overstay in order to be eligible to adjust status.

Hi everyone,

I have a kind of similar question, I've filed I-130 in April 2014 while I was LPR and it was approved and I became a US citizen while my husband has been waiting for PD to become current. We received this welcome e-mail from NVC how to proceed with the Embassy. I've sent all papers to NVC telling them that I am US citizen now and that we are both in the US, but I know it takes up to 60 days to get an answer.

Can my husband file for the AoS without any answer from the NVC?

You dont need to wait for NVC to answer you. You can immediatly fill out forms I-485 and i-131 and I-765 to USCIS.

They will contact NVC aand ask to return your documents from NVC to USCIS

But when my husband file I-485 what kind of proof does he attach to the application? Approved I-130 petition (it is written there that it is "Approval Notice Section: husband or wife of permanent resident) or a copy of my naturalization certificate or both?

P.S. I don't know if it is important, but he is here with B visa, not K or anything based on our marriage.

Try to include a copy of anything you think it would be helpful. By the way, calling USCIS prior to the documet submission could be helpful too. They usually answer quickly and you can ask every question you have in your mind. If you calk them tomorrow, you can make sure what documents have to be submitted.

Try to include a copy of anything you think it would be helpful. By the way, calling USCIS prior to the documet submission could be helpful too. They usually answer quickly and you can ask every question you have in your mind. If you calk them tomorrow, you can make sure what documents have to be submitted.

My update about my case (maybe it would be useful for somebody):

So I've called USCIS and they said that we could not file I-485 right now, but they e-mailed on my behalf to NVC to update my I-130 and to ask them to send our case back to USCIS. They said that we would receive a letter within 15 business days and then my husband can file the AOS.

Administrative Processing is mostly terrorism checks. Whether you believe it or not, that's what it is.

If you search Administrative Processing on these forums you will find scores of people who have been affected, most of them from the regions I mentioned. Most AP is cleared in a few weeks; in some cases it can take a few months; and very rarely it can take years. I have read of a couple of cases here where the wait due to AP was 5+ years; I believe in both of those cases the beneficiary was from Pakistan.

I got my EAD in a normal timeline and got approved for the green card right after the interview and received my green card yesterday. I just wanted to let you know there is no terrorism check (!!!!) whatsoever for anyone from any part of this world. So next time, don NOT say anything if you don't have information about it or if you only follow FoxNews' craps!

If you intend to file for AoS then you should not pay any fees to the NVC. When you submit your I-485 and include a copy of your already-filed I-130 NOA, USCIS will request the approved I-130 back from the NVC themselves.

Does the NAtional benefits center request the approved i-131 from NVC or the field office requests that?
