Flu vaccine and immigrating on IR-1 visa

18 posts in this topic

Recommended Posts

I was just approved on the 1st of April yeah!

At my medical the only vaccine I didn't have was the flu vaccine. They said I didn't have to get it there as you can travel on a K3 without vaccines, you just have to get them before change in status -what exactly does this mean???

And since I will be traveling to the US out of flu season do I still have to get it??

Only ask as now it is out of flu season very hard to get the vaccine (very silly on my part should have just had it done at medical :0/)

Many thanks in advance for any help

From what I undestand, you only need the flu vaccine during the flu season. If you file to change your status prior to flu season you should have no issues.

Congrats! And Good Luck!

K-3? Are you sure? Your timeline actually suggests a CR-1 with the amount of time spent at NVC, can you verify that it is in fact a K-3?

good luck

I agree with Bill & Katya - The flu vaccine is only needed during the flu season.

Your visa is not K3. It is IR1. You will become a permanent resident receiving a 10 year greencard when you enter the US. There will be no adjustment of status for you or removing conditions on your residency. You are done, so no shot worries.

You basically dodged a bullet. Your medical was during flu season and as an IR1 visa applicant, you DID need a flu shot prior to your London interview. However since your interview happened the first day out of flu season (Apr 1), you were granted a waiver on the shot because it was no longer flu season and not required for interviews Apr 1-Sept 30. Had you interviewed two weeks earlier, they would have had to send you back to Knightsbridge for a flu shot before they could approve you.

You filed an I-130 and I-129F, did no document intake at the NVC, and went straight to the embassy?

Your timeline suggests otherwise.

I'm confused, I filed an I130, no I129f.

Thought you were classified as an Ir 1 if you had been married for less than 2 years

Either way I don't need the flu vaccine because I'm out of flu season, correct

Thanks

Lol no. I know the acronyms are confusing. You're classifed as a CR1 if it has been less than 2 years and an IR1 if you have been married for 2 or more years at Point of Entry (POE.) K3 is an entirely different spousal visa. You will not be adjusting your status in the USA so you need all the required vaccinations before interview.

Because the interview was okay you're golden! Congrats!

Congrats on your approval!

If you would take a moment to change your profile to show the correct visa IR-1 :) then it will help with the way the stats on the site work and for those who are looking for similar cases.

Isn't K3 an obsolete petition?

Anyway, no worry to fool around with "money hungry, civil surgeons".,.,.,..,flu season is now gone.,.,.,.,.thank goodness!

k3 is still on the books but it would be extremely rare for one to go through. If the I-130 is approved before the I-129F that is also filed, then the I-129F Is administratively closed and basically can't proceed to a K3. K3 was useful when I-130's were extremely slow and I-129Fs would get approved much earlier. Then the I-129F/K3 would proceed to the consulate instead of being shut down.

Still find it crazy that people immigrating here are required to have flu shots and other immunizations yet as an American we don't have to have them. Kinda dum imho. One would assume person immigrating it'd be kinda equal to us and what we have.

Ametican's do have immunization recommendations like flu shots and updating tetanus. The difference is there is nothing being held over your head to force you to do it. Kids can't attend school without shots. New immigrants can't enter the country. But adult Americans and LPRs have no consequence for not following the CDC guidelines.
