Timeline

Does any know how long the expectation is for an K1 visa in regards to how long you have been dating your fiancé? I met my fiancé online last July and flew to Jamaica in March ( a few weeks ago) to meet. I recently submitted the I 129 forms with proof of our relationship including phone records text and included pictures of us together from my trip, flight info, hotel info etc etc etc... I am thinking since my relationship is under a year, would that be grounds for refusal. Help please!

Timeline

There is no requirement for any certain length of time for the relationship. The I-129F petition requires that you met in person at least once within the 2 years prior to filing, and then you need prove to the CO that your relationship is bona fide and not for immigration purposes only when interviewing for the K-1 visa.

Help me understand what a CR-1 Visa is

CR-1 is a visa that a spouse who is married to their partner for less than 2 years upon US entry receives. It's exactly like the IR-1, except it only gets a 2-year conditional green card (on which conditions must be removed for the 10 year GC before the 2 years expires).

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

Ohzee, your time line with your fiancée actually matches ours! When my fiancé has his interview, I plan to send a signed letter addressing this. Before we met, neither one of us believed in dating without serious marriage intentions. Our engagement was a few months after we made contact, so I was thinking this may be a red flag for the officer. In my situation, I could not maintain a friendship with him when my emotions were getting deeper - it would have been inappropriate.

It's good to know that a short relationship isn't grounds for refusal! I may face different challenges as your journey, but I wanted to comment on our similarities.

That is amazing you guys got us in all areas by 1 week to the date I received my email and text today that my application was received March 30 and will be forwarded to CSC.it will be good to know how this plays out. Anything is possible and luckily meeting online is not taboo any longer. Good luck to you in this entire process it's stressful but no risk no reward.

Important to remember that the 129f is a petition to alow your fiance(e) to apply for a visa. So long as you meet the minimum requirements (being a citizen, having met, not having filed for another in the last two years, etc.) your fiance(e) will receive an interview for their visa.

We met in the beginning of February, I filed in mid-April, the petition was approved mid-August and Jamnan's interview was in late September. The point being that you will have more than enough time to build your relationship before it gets looked at by the CO at the embassy. Review the guides and the embassy reviews to build your evidence packet for the interview stage unless you are in one of the "must front-load" countries.

Jamnan received her conditional green card a day before the first anniversary of our having met.

there is nothing in the requirements stating that you can not petition for someone if you had petitioned someone else within the previous 2 years. Don't make things up/ This is directly from the USCIS site stating the requirements.

Eligibility Requirements

If you petition for a fiancé(e) visa, you must show that:

  • You (the petitioner) are a U.S. citizen.
  • You intend to marry within 90 days of your fiancé(e) entering the United States.
  • You and your fiancé(e) are both free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
  • You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:

    1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.

    2. If you prove that the requirement to meet would result in extreme hardship to you.

We met only for 2 months before I submitted I-129F and got it approved...and we are married for 5 months now.

It's funny you say this. My then-Fiancee & I did the exact same thing. Within 2 weeks of meeting online, we were already gauging each other fully to figure out what each was willing to do if this developed into something romantically & we figured out that we both were willing to do whatever it took. We then continued to basically fall in love online, communicating via text & Skype until about 4 months after meeting online, when we met in person the 1st time & reaffirmed our feelings for each other. I had such a strong feeling about her that I bought he ring that I would propose to her with before she even came. While she was here, I proposed & then sent the petition away about 3 weeks later.

Like you & the OP, we didn't wanna waste time getting to know everything about each other without fully working to close the distance gap. So that became an immediate priority. Nothing is wrong with a rapidly developing relationship, if it has been built with long-term intentions from the very beginning.
