Hey guys,

So I got married last week and my wife is here on K1 visa. I went to the get her a SSN but they told me that she needs to have a "work permit" in order to get a SSN. This seemed really odd because the first day i went and they told me everything is good i just need the i94. We went back with the i94 and they told us (different person) she needs a work permit to get a SSN. So now I am filling for AOS and the work permit, although she wont work because shes still a student. anyways... thats the situation i am currently in.

My question for you great folks is, AOS packet is asking for the g-325a. Is this the same g-325a we filed during the visa process? or does new and current info goes on there, for example the current address should be the address here in the US, correct?

Please help.

If there is more than 2 weeks left before the I-94 expires, then you can get the SSN based on the I-94 and K-1 entry. You need to file for the SSN in the maiden name though. You can get it changed to the married name later, after you file for AOS in the married name and have the EAD/AP or green card in married name. This might be why the SSA worker said you needed the EAD. If the I-94 has less than 2 weeks until expires, that is another reason you must wait for the EAD to get the SSN.

AOS is a whole new, separate process from the K-1. Why would you fill them out with your past information? Fill out all AOS forms with your current, updated info.

Her maiden name and my last name are the same. so the name change isnt an issue for us. The i-94 doesn't expire till July 2015. So i dont understand why she was denied the SSN with i-94 and k1 visa on the passport.

Yeah I realized the info on 325a is the same as the first one we filed only difference is the new and current address...

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Ok...this is gonna be bit confusing so follow along closely here...

From my experience and from talking to one of the SSA staff...

1) Had she applied for SS card before the marriage with just her passport and I-94,

she would have gotten the SS card.

2) After the marriage, this is where it gets tricky...

We went and tried it twice to have her last name changed to mine,

and failed during processing without even sending us.

So on my 4th visit to the SS office, I complaint vocally and demanded some answers,

and one staff explained that without EAD or GC, her attempt to change the last name

will fail (almost all the time).

Heck...so I complained if they know this, why did they even bother to accept our application,

and their answer is depending on the her background in terms of what visas she's had before

some could actually pass the security check so that allow the application...

but nearly all first time US (fiancee/spouse) visa applicants will fail.

3) Back to your situation...since her maiden name and your last name is same,

I think there is a chance that it might go through...but the staff that you are dealing with

is probably thinking that she changed her last name...

ARGGGG....so you have the opposite problem that we had.

They shouldn't have taken our application, but should have taken your's.

4) If you can go to another SS office, or get another SS staff, they might accept your application.

In our SS office, they are happy to take the applications...even when they know it'll fail.

But in your wife's case, since she's not changing the last name, I think it will work.

Give it another try and tell us later what happened.
