Hey guys,

I know you can always be denied entry Into US no matter what,but I was just wondering how risky traveling on AP really is.

I came over in Nov 2013 on a k1 visa and married two weeks later.me and my husband were really lazy in applying for AOS,one we just wanted to enjoy being normal newlyweds without the stress of paperwork etc and I guess time just went past ,anyways we finally sent everything off the start of March and I received my hardcopy noa for AOS ,ED,and AP last week.

We really want to visit my family in England around October so that's why I applied for AP as no idea on how long my greencard will take.if my green card is close to being approved by October I'll probably push my trip back untill I have it ,I am considering traveling with AP if not though so just wanting to know how risky it is

I have only traveled to America once before I came here on a k1 and I didn't overstay.my husband is in the military so I plan on having my dependant I.d card and marriage certificate on me as evidence,I don't really see why I would pull up a red flag and be denied entry but just looking for other people's opinions

You shouldn't have any issues. You'll likely have your green card by October, anyway.

Mar 18 2013: I-129F mailed to CSC Nov 15 2013: I-485 with EAD/AP filed at Chicago Lockbox

Sept 19 2013: Interview - Approved!! Jan 25 2014: EAD/AP Card Received

Oct 6 2013: POE - Chicago O'Hare June 2 2014: Permanent Resident Card Received!

I doubt you would have any issue travelling on AP.

Per Matter of Arabally, the INA 212 overstay bars do not apply to someone granted AP based on a pending AoS application.

I would love to have my greencard by then for sure !I definitely regret not applying for it sooner than I did, but oh well at least it's done now lol

IT IS SAFE to travel on AP. I used mine to travel back home to Ghana, Africa last Dec 2014 and stayed for 5weeks. I flew through Amsterdam and nobody asked me anything. On my return to the US, the immigration officer at JFK rather stamped my passport extending my AP for a year (Jan 2016). No questions were asked leaving and retuning to the US.

YOU ARE VERY SAFE. By the way, my AOS is finally approved.

Keep a copy of your marriage certificate with you.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

In 18 months here on VJ...I've seen many asking questions on traveling abroad with AP,

but I can't seem to recall anyone complaining of reentry denial in circumstances like you.

You shouldn't have any issues. You'll likely have your green card by October, anyway.

We submitted AOS in early Dec/2014, and we just received the potential interview waiver letter

that estimated about 6 more months of processing time...meaning around Sept/2015 time frame.

Since Jola83 just file 3 weeks ago, unless they get interview scheduled and decision moves

faster than mine, there is a good chance that she will not have GC by October timeframe.
