Need advice and time table for K-1

My fiance [the canadian] has a kid but he will not be coming with us, k-1 obviously.

Will she have to list that in the forms?

The child can accompany her on a K-2 visa. Even if he does not, she must put the information on the form (page 3 starting with question 16a) here: http://www.uscis.gov/i-129f Edited by CatherineA

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

My fiance, Canadian. I'm american.

It is my understanding that we must get a k-1 then marry or else it is considered fraud. We are both in Canada right now, i'm just visiting.

If she comes back to the states with me [ florida ] while I process the k-1 how long can I expect her to stay until she has to go back to Canada to handle her side.

I read the stickies , guides / faq but I still don't understand fully.

I want to keep her physically with me as long as possible, can anyone guide me in a way to do this? She also would like to work if possible while during her green card process. Will it be hard for her to get a job with a EAD i think its called? Will employers look down on her or will it be hard for them to employ her with one?

I have to file for a temporary work visa after or can I do it at the same time as the k-1. I've heard both so I want to make sure.

Will an immigration lawyer speed this up? I know I can't expedite k-1s.

SO I send the petition and wait for approval, that takes anywhere from 1 month to 6 the faq said.

I then wait for it to be proccessed at the NVC and then sent to the consulate...

Thats when she can pick it up, correct?

How long does the proccessing and the NVC take, how long for them to send to the consulate.

I read she needs a medical check, how long does that take to schedule and what other details are going into this on what she needs to do. What is the timeframe she needs etc.

I value any opinions you share. Thank you

I am American and my fiance is Canadian (from Toronto). He is currently here with me in the states and we have just filed for K-1 in March. He has been here since November and his I-94 expires next month (6 months after his entry). He will go back before his visitation expires and will not be in violation. It is perfectly legal to file for K-1 while your Canadian significant other is here. In fact, there is a question on the form that asks whether or not the Canadian fiance is here. The Canadian would, however, need to return to Canada before the 6 month visitation deadline is up. Otherwise, you could jeopardize the entire thing.

If shortening the wait by 6-7 (or more?) months is important enough to you, you may wish to seriously consider having the USC petitioner move to a state that is serviced by the California Service Center prior to submitting the K-1 petition. Moving back to Florida after you submit the petition and receive an NOA-1 is an option.

The CSC states are the green states in this map.

Well, this map doesn't guarantee anything as MANY people that live on the pink side, like myself, are being rerouted to CSC. Moving won't help and honestly, who the heck would do that? No one...

This is what it was up until three weeks ago. They *just* changed the policy (on March 27) that instead of getting routed by state, incoming petitions are routed based on the relative wait times of the service center. That person shared that map on March 23, before the announcement of changes with the adjudication of I-129fs was made, and weeks before we all figured out what the change *was*. That person was 100% correct at the time they shared that information.
