I would consult a lawyer in addition to filing for divorce, in case there are some hurdles you will need to go through when the divorce gets filed. I read somewhere that if he has not gotten his interview yet, you can write a letter to USCIS asking them to withdraw your petition and refuse to attend any scheduled interviews - BUT he can still file for removal of conditions even without your signature, which is where you may need the help of a lawyer.

I guess the main point is to prevent him from receiving his permanent green card, because you won't be able to do much at that point, even after divorce.

his petition was approved before he received his visa. She can withdraw her I-864 and she doesn't need a lawyer to do so

Withdraw the I-864 at once,

Then file for divorce at once, and have him removed from the residence. DO NOT, let him "sweet talk" you out of this, as he has gone too far, and will never change.

I really read too many of these stories on here lately, it seems to be getting worse.

To the OP: I know how it feels like being left by someone we dearly loved. I may not in the same situation as you are but whether you like the situation or not, you need to be strong. It will be really hard to deny him with any sweet talk that he can brought in but you need to convince yourself that you are dealing with a con artist. You may be deceived by his sweet talks and you may think that he change or whatsoever.. but sad to say, he will just try to manipulate you if ever just to get his GC.

You need to get out yourself in this very tough situation that you're going through. I'm sorry that you have to face such an awful situation but all you can do is face it and move on.

Please be strong and tough, he is a con artist and his motive for just getting a GC will not change. :( I'm sorry

Please do as has been posted and contact to pull your affidavit of support and file for divorce. If you are worried about his actions after you do this please get to a safe place, such as a friend or relative whose address he does not know.

Entry on a K1 visa, marrying and then completing the AOS is not illegal and is in fact the correct process for the K1 visa. Please do not vilify those of us who were not yet married when we decided to move to the US for having chosen this route.

The K1 Visa application form on the embassy websites is the same as the non-immigrant form but the instructions for most embassy's do list it under immigrant visa.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

2. Get a divorce.

3. Change the locks, maybe he will stay out of your hair and change his room and board permanently to the other woman's house.

4. Breathe.....take a break.....keep on going, someone that deserves you is out there when you are ready for him.

He is not worth to get upset over. Men like him think they are so smart to never get caught and that just makes them very stupid.

His double life will bite him in the butt soon enough. His choices = his consequences. Don't look back and set your standards higher.

Too often, people are too quick to condemn the other party without hearing their own side of the story. So many Posters can never present their own fault but the fault of the other party who is unaware of his/her case being judged lol... The way to obtain a fair judgment is to serve the other party motions of your petition so that he/she can say his/her own side of the story. I don't believe everything people say about other people because human beings can be bias, vindictive, and name it!

True, but for what its worth even if the applicant have fallen out of love that quickly

(playing devils advocate) petitioner no longer have a marriage.he may no longer be there

in the role of a husband, no time has been put into the marriage, and most of all she

does not want to be financially responsible ....She must derail this responsibility to

herself, and whether he's allowed to stay or not, do not let that concern her leading to

bitterness, se just do what will no longer be a cost to her also file for a simple divorce ASAP

OP I think this guy got your nose wide open, might I suggest you use your money and

see a therapist who help U to end this now...I have a feeling he can lure U in to him

and U need help to put it to rest

We can only go on what is being presented to us here. Yes, there are two sides to every story but he is not allowed to enter on a K-1, get married, then ditch his new wife for someone else. It doesn't work like that. That's not the reason for the K-1 visa. He is in the US as a fraud now and must return home.

The OP said she does not have money for his AOS, so obviously, no I-485 was filed at all, only EAD so the guy could work, and it should've been filed like 9 months ago the latest, before his K-1 would expire. I do have a strange feeling about him becoming a bad guy now, when apparently he insists on AOS which would cost $1070.
