i-485 RFE a little confusing!

Hi All,

My husband and I received an RFE on our I-485. I am just a little bit confused as to what they are needing from us and hoping you all could help us out. The letter states:

This office is unable to complete the processing of your application yada, yada, yada ..

They ask us to submit all supporting tax documentation (W-2s, 1099s, FOrm 2555, and all supporting tax schedules) submitted to the IRS for the most recent tax year.

The petitioner/sponsor must submit all supporting tax documents for the most recent tax year.

My husband and I mailed our application in February (see signature) but we had yet to file taxes for 2014 so I mailed 2013 as this was our most recent tax year we had filed. Are they requesting this because we should have mailed 2014?

Also, on page 2 it says:

Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% (100% if military) of the poverty guideline.

It then goes on and lists all of the evidence of assets we could send in ..

This is the place where I am most confused as the poverty guidelines for 2015 for our household is $19,912 and my husband made over that amount. Is this again because we mailed 2013 and they want to see the income for 2014?

Sorry if this has been asked and answered, I searched and could not find anything matching this exact circumstance.

03/13/2015- RFE received in mail

03/23/2015- Sent RFE back to USCIS

03/26/2015- USCIS website updated to 'RFE received'

04/07/2015- Online status: 'Ready to schedule interview'

04/27/2015- Called USCIS in hopes to speed up EAD, was told to wait until day 75

04/28/2015- Emails received EAD card is in production! (Day 70)

05/07/2015- EAD combo card received in mail

07/28/2015- AOS Interview

08/28/2015- Online status changed to Card in Production!!

hi

what other supporting documents did you send along with the i864 and the 3 years of taxes? or did you just send one year of taxes?

did you send also the employment letter, paystubs, w2s or nothing else?

if so, it is possible that they might have lost them

I only sent the one year (2013) of taxes, and nothing else.. My husband is self employed so he does not have W-2 .. should I send them copies of paychecks?

Hi, I am hoping you can offer some more advice. My husband was living in Canada with me in 2013 and so the income submitted was foreign earned. Are you allowed to use foreign income? He moved back to the US in July of 2014 but his checks are mailed to him from Canada. Would it be advisable for me to send copies of his checks? Showing that his income is continued in the US? It says on my RFE to send 12 months of bank statements, but he does not have statements for all of 2014 as most of the year was spent in Canada. Should I send statements of the last 6 months of him being in the US. The amount of money deposited is over the poverty line..

Also he filed his taxes late and I saw that your supposed to include the transcript from the IRS if this is the case but we have not received the transcript yet and the online site will not work for me. It keeps stating the information does not match the records on file.

Please help.

I think I can use my sister in law as a joint sponsor, but will i still need the transcript for 2013?
