Citizen's passport almost expired while applying for GC

My husband is US citizen. We are about to submit my application to get a GC.

I just founf out his passport will expire in August 2015!!!'

Should we get a new passport first and then submit our application or we can still use his passport?

I am in hurry to get EAD joint with the application.

Please help.

Hello Boiler,

Thanks a lot for your quick response.

In the instruction of I-130, under "What documents do you need to show that your are a US citizen". Bullet 4 says that "A copy of your unexpired U.S. passport"....

So by the time we submit the application, the citizen's passport is not expired, but it will expired soon in August...

You were suggesting we don't submit the passport? I thought it is required :(

~~moved to AOS from work, student, and tourist visas from what visa do I need~~

1) it doesn't matter if it's about to expire as long as it's not expired when you submit the petition and AOS paperwork

2) you could also submit a copy of their birth certificate OR a copy of a naturalization certificate. With our petition (which was for the CR1 path) we sent in a copy of my husband's birth certificate. Certainly easier to send 1-2 pages vs the entire passport.
