Question about Adjustment of Status

Timeline

I read that you must start AOS right after marriage. Is this true? I had planned on me and my fiancee to have our marriage at some point during three month visa and then file for AOS at the start of the final month. I need a little time to save a bit in order to pay the associated fees. So the question remains does it matter when you file for AOS as long as it is within the 3 month timeframe?

By the way, I thank everyone for and visa journey for aid in this entire journey. And I wish speedy approval and good luck for all who are waiting to see their significant others.

The only time limit is to get married within 90 days.

There is no time limit to file AOS (although you should file as soon as you are able).

NOA1: 04/08/2014; NOA2: 04/21/2014; Visa interview, approved: 07/15/2014; POE: 07/25/2014; Marriage: 09/05/2014

NOA1:  09/12/2014;  Biometrics:  10/06/2014;  EAD/AP Received:  11/26/2014;  Interview Waiver Letter:  01/02/2015;  

RFE:  07/09/2015;  Permanent Residency Granted:  07/27/2015;  Green card Received:  08/22/2015

 

ROC

NOA1:  05/24/2017;  Biometrics:  06/13/2017;  Approved without interview:  09/05/2018;  10 Yr Green card Received:  09/13/2018

 

Naturalization

08/09/2020 -- Filed N-400 online

08/09/2020 -- NOA1 date

08/11/2020 -- NOA1 received in the mail

12/30/2020 -- Received notice online that an interview was scheduled

02/11/2021 -- Interview

You need to apply after the marriage; it's fine if it's not immediately following.

2015-03-16 EAD/AP combo card received


2015-03-26 Interview scheduled online

2015-04-28 Approved for GC at AOS interview

You must get married in 90 days. The longer you wait on AOS, the longer it will take for you to be able to work or get your green card.

04/09/15-Mailed ROC

04/10/2015-Package received

04/14/2015-Check cashed

06/02/2015-Called Service Center (still no NOA1) Service request found out wrong address on paperwork! :(

06/03/2015-Called to get address updated Ar11 online add change didnt work-got infopass for June 10th

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

To fulfill the requirements of the K1 visa program, the alien beneficiary has to marry their USC petitioner within 90 days of the beneficiary's US arrival (POE). As others have mentioned, the general forum recommendation is that, after marriage, to file for Adjustment of Status (AOS) as soon as you are able.
