Hi friends,my co-sponsor did not file his taxes for 2012,he is a truck driver so than he was driving for a private owner and receiving personal cheques and no tax,so he did not file for 2012,but he filed for 2013 and 2014 when he got another job.please i need a clue of how he will write a letter explaining why he didnt file his tax for 2012.urgent please

Hi,

He worked in 2012. He needs to file and pay his taxes. It doesn't matter if he worked for a private owner. He worked and has to file and pay his taxes.

A letter explaining why he did not have to file would be fraudulent since he is and was obligated to file.

Even if he was being paid as a 1099 Independent Contractor he still needs to pay his taxes. If he chose to not file and pay because he was receiving under the table, I would consider a new co-sponsor.

I was a private contractor in 2013 and got paid with a personal company check . It's called a 1099. If he made over the limit to file taxes (I think lie $9800) he still has to file taxes. The employer sent what they paid him to IRS he needs to do his part. He woes the IRS of he didn't have taxes take put his check.

Don't even try to sedn this into NVC without filing or you will just mess yourself up. And Remember You are dealing with Lagos.

If I recall correctly he needs to file no matter what he made, however if it was over $600 his employer needed to provide him with a 1099-MISC form at the end of the year, a copy of which was filed by them with the IRS (if said employer was doing everything correctly) and also his pay would have been included on their 1096 as well.

To the OP I wouldn't bother trying to get by with a shifty tax-evading co-sponsor, especially dealing with Lagos. I would look to find a new one.

He has to file his taxes, the government know he worked and made money. He will have to file it as independent contractor. Either that or you better get a NEW better joint sponsor to avoid yourself troubles.

In addition to my full time business, I work on the side preparing taxes during tax season. Let your co-sponsor know, IRS eventually WILL get around to asking him why he didn't file taxes in 2012. They don't over look anything! When that happens, if he tells them he didn't work that year, they'll want to know why. It'll be like the story, "If You Give a Mouse a Cookie", but his story will be, "If You Lie to the IRS"

If you use him as your sponsor, it's you who will end up having to lie, and it will be to the NVC, when they ask why there are no taxes for 2012. You don't even want to imagine lying to NVC about anything!

Whether you still want to continue with him as your co-sponsor or not, tell him to file his 2012 taxes ASAP. The taxes and penalties he'll have to pay are very small potatoes compared to what will happen later if he waits until IRS calls him out on this.

its 2012 taxes.. the immediate returns is what matters.. You don't have to commit yourself by bringing in 2012 taxes..You should sail through if you dnt bring it up.However, let him file for IRS sake but I think you good for immigration
