I-130 Adjustment/New Petition for new born baby

Hi,

My petition is under spouse category (F2A) and now we have a 6 months old daughter. Should be furnish a separate I-130 for our baby girl or her case is automatically get adjusted with my husband when his PD will get current?

We are expecting that the PD will current shortly in few months. Please advise!

Hi,

You do not need to file another I-130.

Your child is allowed to be a derivative beneficiary on your husband's F2a case.

Thanks aaron, May you please tell me how it will work, How my baby appeared for interview etc.

May you please guide me the steps after my husband's date will be current. :)

When NVC contacts the beneficiary/petitioner for further processing (fill out the DS261), inform them thru email that you would like to add your child into the petition. Attach a scanned copy of the child's birth certificate. That way, NVC will add the child as a derivative and invoice the baby's IV fee.

lets assume if we dont want to bring our baby to US and wish to keep her with our family (grand mom) in India to learn our language and culture etc. and we may file a petition for our daughter at the age of 3 year etc, is it possible in this way?

Sure you can delay. Just make sure that the child is added to your wife's case so you won't have to file another i130 and wait for an approval.
