Timeline
My father-in-law applied last year asking a green card to bring his mother from Brazil to live here in the United States. She got here in October 2014, all procedures were done correctly. She already has her social, but the green card has not yet arrived.

The problem is that she wants to go back to Brazil.

Our questions are: We can let her go to Brazil before the green card arrives, and then send the green card by mail for her in Brazil?

Is there any possibility of "switch" the green card for a tourist visa?

She should have an I-551 stamp in her passport. That serves as a temporary green card until the actual card arrives. If she has the stamp, there is no problem returning to the U.S. following a short trip. You aren't clear if she wants to go back to Brazil for a vacation or to reside. If she plans to return to Brazil to reside, she may forfeit her U.S. residence.

Then she will no longer be a U.S. resident. She will no longer qualify for a green card.

She wants to go back to Brazil for good. But she could come back here for visit...

Then she will give up her green card. You can't be a permanent resident and not also be a resident. It's not a "feel free to live abroad and to visit whenever you want card" (a friend of mine's mother in law refused to stop thinking of it that way). If she wants to live in Brazil and visit, she'll have to get a visitor's visa which (depending on what they give her) can be valid for up to ten years, for visits of up to 6 months at a time.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

She will loose her resident status in US if she leaves for good. She will have to apply for a tourist visa I guess.

I just saw the part where you were asking about "switching" to a tourist visa, I looked around on USCIS and State's websites and found that there IS actually a way for this to happen---well, not a tourist visa.

She could apply for a re-entry permit before leaving but apparently this does not guarantee re-entry (again, she has to show that she doesn't intend to abandon residency---which she does). This is good for one year.

Longer than one year, she'd need a "returning resident visa" . It sounds like these may not be easily gotten--you need to prove that you did not intend to abandon residency, that the prolonged stay was beyond your control, that you are still admissible, medical exam, vaccination records...all that again.

I doubt that you can apply for a re-entry permit before you even have a green card, but I suppose you can try. In terms of switching to a ten-year tourist visa...I really don't know how that would work out. Sounds doubtful because she has or at least had immigrant intent. Sounds like no matter how you cut it, you're in for a big expensive headache. It's her business, of course, but is something so pressing in Brazil that she can't just wait it out until citizenship or at least keep real residency in the US and visit Brazil for a few months at a time?

It sounds like the Mother simply doesn't want to live here permanently. This happens, especially with older people who are set in their ways.

If the Mother abandons her greencard by returning to Brazil for good, obtaining a tourist visa shouldn't be too difficult so long as she re-establishes ties to Brazil. She has clearly shown she does not have immigrant intent by giving up her greencard. It would be wise to voluntarily turn in her greencard before she leaves rather than simply abandoning it, that shows she willfully gave up her residency.
