Hi!

I just saw that the poverty guidelines changed for 2015.

I am worried that our application will not be approved because my fiance is on SSDI. He received 18,623 for 2014. We are aware that this is not enough for the 125% requirement, so he decided to rollover some USD7,413. He also has IRA distributions amounting to 4,413.

I am not very much knowledgeable about the income requirement part of the application, so I am hoping that someone can help me. I read a thread about how the Manila US Embassy does not accept co-sponsors, so I guess that is a no-go for us.

Can anyone explain to me how this works? What should we do?

1.) As of right now it seems like Manila is not requiring I-134, But I would have it if needed.

2.) Yes Manila does accept Co-Sponsors and it is on case by case basis

I will let some one else who is more about SSDI and IRA roll over handle the rest of the questions.....

what is SSDI ? I would love to be updated with this too.

It is Social Security Disability Insurance. My fiancee is receiving this because he is legally blind. He has retinitis pigmentosa (RP).

I am the aforementioned fiance. My 2014 income from SSDI (Social Security Disability Insurance) was $18,623. I had a 401(k) in the amount of $7413 that I rolled over into an IRA, then from that amount, I converted $4413 to a ROTH IRA, so that amount was counted as taxable income. Line 22 of my 2014 1040 form was $4446. (Total Income) Line 20a was $18,623 (Social Security Benefits). For 2015 I will convert the other $3000 from the IRA to a ROTH to boost my combined income over the minimum threshold, and I received a slight increase in my SSDI benefits.

It was my understanding that SSDI is accepted as income by USCIS (SSI is not) and we should be safe with the additional taxable income from the ROTH conversion. I also have another ROTH IRA valued around $15k to go along with the $7413 as well as a life insurance policy with a cash value around $6k and I own my home, so there sould be equity in excess of $50k.

Does the Affidavit of support rely solely on gross annual income, or would my assets be taken into consideration? A co-sponsor is not out of the question, but we would prefer to avoid that route.

Yes, SSDI can be used. It is income. It is non-taxable though, so you must provide proof of the income amount you receive. A benefits letter/statement from the SSA that lists the amount you receive, plus your SSA 1099, and even bank statements showing the amount that is deposited each month can be used for this purpose. If they do not see it on the Total Income, line 22, of your latest 1040, then they may overlook it, which is why you have to provide as much proof as you can of the non-taxable income you receive.

Assets can be listed. There is a place on the I-134 to list your assets, so list all you have. You just need to convince the CO that the intending immigrant will not become a public charge once in the US.

Many times USEM is not asking for the I-134 or supporting documents during the interview, still it is best to have them on hand for the interview.

Your gross income needs to meet the poverty guidelines, which for two people is $19,912 now. USEM does not consider assets to meet these requirements. USEM does accept a co-sponsor with the K-1 on a case by case basis, one thing they want is for the co-sponsor to be a close relative.

what is SSDI ? I would love to be updated with this too.

In a nutshell it is a federal program that you pay into when you work in the US. Once you have completed 40 quarters of work you are eligible to receive a payment once you retire or become disabled and not able to work. What should you do? It appears you might be living on $1,500 a month, stretching a once-a-month payment from the 1st of one month to the 1st of the next. Prepare to live on a VERY tight budget. $18,000 annually might sound like A LOT in the PI, but that as a sole income is poverty in the USA. I suspect the USEM will flag your case and want to see more $ at your interview.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
