Hi guys!

Here is a short question to those who know:

If in 2014 i got married to US citizen but was not working and got my GC in February 2015 do I file taxes for 2014 or not?

I called H&R block and asked the same question, they said if I was not working I do not file anything. But the info on IRS web is confusing, saying if one lived in the US when married to USC he/she may file taxes and will be considered as filling as a resident (even if not resident yet) and not a single word if its only for those that worked or anyone.....

Will appreciate consultations on this!

K-1 timeline:

11-07-2013 - I-129F form sent ---> 11-15-2013 - NOA1 - e-mail received, transferred to California Service Center.

11-20-2013 - Alien registration number changed.

11-22-2013 - NOA1 hardcopy (I-797C)

12-13-2013 - NOA2 approval notification ---> 12-20-2013 - NOA2 hardcopy

01-08-2014 - NVC recieved ---->01-09-2014 - NVC left

01-13-2014 - Consulate recieved ----> 01-14-2014 - E-mail from the Consulate

Thanks, I went through it already, and again from what I understand I do not need to file taxes for 2014 because I did not had any income or was employed, correct?

No you do not need to file taxes because you had no income for 2014. Although Your husband and you can file tax married/joint, this may benefit the both of you. Thats how my wife and I filed our taxes this year.

We married in 2014, She also did not have a job or income for 2014, and received her green card Feb 2015.

We just filed taxes for 2014 and i filled together with my wife. She doesn't even have a EAD yet. Your husband can claim you and that way you will have a bigger refund unless you are in a situation where its better not too. I don't think he could file taxes without mentioning you on the tax forms because you are married. Also just my opinion, H&R block is not at all a good tax service and they have only very generic answers that work for people who are typical residence with normal easy situations, they don't know how to go outside the box. Plus they are super expensive.

Loving_girl, you DO have to file with your husband a jointly tax return, regardless of your immigration status and income (unless the total family income for 2014 is below requiring threshold). Just make sure you got SSN if not yet.

The determination tree for a filing status starts with a question: Were you married on the last day of the year? ( so to IRS you are married (even with a K1 visa) even if you got married on Dec.31 2014).

I think you are confusing married with joint tax return. She does not have to file anything because she earned no taxable income.

Her husband, if he earned taxable income, would have to file as married instead of single because he was a married person on Dec 31. He could file Married Filing Separately. Separately...meaning by himself and she files nothing. That isn't always the best option for the lowest taxes for him.

They also have the option to file Married Filing Jointly.
