We will be filing for a K-1 this week, via the California service center, for my fiancée who is in Brazil. My lawyer (who has done a lot of these) says we should expect it to take around 8 to 10 months to have a visa in hand. However, looking at the stats here for this combo, it looks like it has been taking most people more like 3 to 5 months.

Am I missing something important about reading the stats, or is my lawyer just giving an extremely conservative estimate?

There should not be any red flags or particular complications in our case.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Well I got really lucky and my NOA2 came around 2 weeks after the NOA1. And NOA1 took about 1 week! But generally takes 4 to 6 months.

USCIS

04-SEP-2014 --- Marriage!

08-DEC-2014 --- I-130 Sent

17-DEC-2014 --- NOA1

05-JAN-2015 --- NOA2

17-JAN-2015 --- NVC Recieved

02-MAR-2015 --- Case Activated; Filled DS-261

02-MAR-2015 --- AOS Invoiced ; PAID

03-MAR-2015 --- AOS shows "PAID"

13-APR-2015 --- IV Invoiced ; PAID

14-APR-2015 --- IV shows "PAID"

22-APR-2015 --- Completed DS-260

01-MAY-2015 --- Mailed AOS/IV Packet

04-MAY-2015 --- Scan Date

03-JUN-2015 --- Case Complete!

23-JUL-2015 --- INTERVIEW!!! (Approved)

I told my son who petitioned his fiancée in goiania to expect the process to take 9 months from start to finish. They received approval in 9 days and visa in hand in 4 months!! Longest wait was for interview in rio - that itself was about 8 weeks!

OUR TIMELINE

K1 VISA & MARRIAGE - 8 MONTHS

17 February 2004 Sent I-129F petition CSC - It was APPROVED in 147 days

3 September 2004 INTERVIEW IN LONDON SUCCESSFUL VISA APPROVED! MARRIED OCTOBER 16, 2004

ADJUSTMENT OF STATUS - 5 MONTHS

4 January 2005 - Submitted applications for AOS and EAD - 12 May 2005 Conditional Permanent Residency Approved - interview in Santa Ana

4 June 2005 CPR 2-year Green Card arrives in mail

REMOVAL OF CONDITIONS - 3½ MONTHS

8 May 2007 - I-751 sent to CSC - 23 August 2007 - Approved - Card production ordered

30 August 2007 - 10 year Green Card received

K2 TIMELINE (Stayed behind in UK to finish school)

28 March 2005 - embassy interview & medical London - visa granted

01/18/06 Applications for AOS/EAD sent - 03/28/06 EAD approved

4/3/06 - RFE for AOS - requested new medical and vacc supplement

4/26/06 - approved without interview and welcome letter sent

05/02/2006 - Greencard arrives in mail

03/14/08 - Petition to Remove Conditions mailed to CSC delivered - 7/2/08 APPROVED

NATURALIZATION TIMELINE (for myself and son) 5 MONTHS

April 18, 2011 - N-400 Applications Mailed to AZ lockbox

April 21 (received April 25) NOAs

May 12 - FP Letters mailed

May 16 - Received FP appointment letters for June 8 at 11am

August 1 - Interview - approved for Oath Ceremony - OATH CEREMONY 28 SEPTEMBER

Well, CSC is pretty fast so you can expect to have the visa in 4 months if everything works fine for y'all. I always mention that we never know what to expect from this process so the best thing is just to wait before making travel arrangements and etc. Good luck!

There should not be any red flags or particular complications in our case.

Your lawyer is historically right, but not correct currently. Your estimate is closer. Of course you never know with these things. CSC in the past has been as slow as TSC, and there are a couple people on this board with cases at CSC that are long even by TSC standards. That being said, those are the exceptions and not the rule right now.

Removing Conditions Timeline

Aug. 10, '17: Mailed in I-751

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received

I met with our lawyer again today, I think I have a better idea what is going on -- the California Service Center itself seems to be reporting a current processing time for I-129F as 5 months... http://www.aila.org/infonet/processing-time-reports/csc/csc-ptr-02-27-15, so that is what she based her estimate on.

But according to the stats on this site, the actual current time is 57 days. So apparently the official processing time report is wildly off?

Don't forget that when you check the processing time here they are always affected by expedited cases (Majority from the Philippines). As everybody already said here CSC is pretty fast compared to TSC. The recent cases I saw here got approved within a month. I don't like to say people to expect 1 week or 1 month because we never know and just stick with their official reports (Same as your Lawyer is doing). It's the best option other than giving people wrong expectations.

Apparently you're digging into the timeframe thing to make your travel and moving arrangements. To be safe it's always better to start some planning after NOA2 because that's when we can have a better idea of the timeframe (NOT saying you will know for sure the exactly timeframe after your NOA2, don't forget we still have NVC and Consulate Processing)!
