A Waste Of Time, But I Said I Would Ask?

I have a good friend, who is a Professor of English, teaching in China. does not have access to the site from his part of China.

He was married in the Philippines, Cebu, 2012.

His wife came to China, and stayed a few months, then left, back to the Philippines, and has not been heard from again! Said, she could not live like that, but the whole situation was explained to her before the marriage, it is not as if she did not know!

We know there is "no such thing as divorce in the Philippines" but there is an annulment, and that takes 3-5 years, and thousands of dollars, and it must be proven that either the man or woman, was mentally incompetent at the time of marriage!

HE WAS TOLD AT A CONSULATE (NOT SURE WHICH COUNTRY) THAT AFTER 5 YEARS, OF SEPARATION, their was some paperwork he could file, somewhere, that would dissolve the marriage! I have no opinion on this, as I am married to a Filipino, and we have a good marriage.

I had no idea where to file this question, move it around if need be Mods., as he just wants to know if there is """ANY OUT"" for him from this horrible marriage!!!

Is he just married for the rest of his life? And wife left him years ago, and not been back, and he has no idea where she has gone to!

Why not get divorced in China that is where he lives.

annulment is 150k in pesos now. No appearance in the court. it will take 11 months to process. my wife is annulled last 2004. we met 2011. just be careful whom you will talk coz in the Philippines if they will learn you are an American they will take advantage and they will charge you more lol

There is no divorce in the Philippines. However a person can divorce person from the Philippines in any other country regardless of where they married .(Philippines or wherever) (A good Immigration lawyer will know that) If he is the one to file for divorce then she being the Filipina is consider divorce as well. If she files for divorce then she will have to get an annulment not him.You should or have your lawyer study the family code of the Philippines. Here is a link to it

It would seem he should file for divorce in China, from what I am reading.

Oh, how things have changed in the Philippines, from 2013, as I was trying to get a gal out of a marriage, and the annulment filing was over 4K..,.,.,plus on-going fees, and I finally.,.,.,.,.,RAN!!!

Found my true lady of love, married happy in the USA, and no problems.

Gosh, 11 months and 150K pesos,..,.,.,.,.,as I said many things have changed in 2 years!

Again, thanks to all, for helping my friend.,.,.,he will be thrilled to hear this news! He can be rid of her!

The code of the Philippines has not change that much.It has been like that for a long time. yes there is no divorce in the Philippines, but a person has been able to divorce in a different country for a long time. People choose what they want to hear and believe. After time what someone chooses to belief becomes a fact for them and then it spread onto family and friends. TRUTH

NO DIVORCE IN PHILIPPINES

YES YOU CAN DIVORCE IN OTHER COUNTRIES.

my wife filed her annulment 2004. right before we met. so it's not two years lol. she did her annulment right before your ex

I think the 5 year rules triggers a presumptive death. If a person can't be found or heard of in that amount of time they may be presumed dead. That is what the US does in missing persons cases

This will not be over quickly. You will not enjoy this.

You didn't say what nationality your friend is, just that he teaches English, this is vital to know

Knowing what nationality he is, IS important to the answer to his question. What answer you have gotten thus far are based on unknown information. That's dangerous!

Why not get divorced in China that is where he lives.

:no: If he is anything but a Filipino, then he can divorce her in China with no problems. But you don't know what his nationality is and if he is a Filipino married to a Filipino they cannot divorce and have it recognized in the Philippines. If they divorce in China, then they can't remarry in the Philippines.

He would still need to go through the court system in the Philippines (if he is a Filipino, which hasn't been established by the OP) and there are another set of parameters he must follow to complete the annulment on presumptive death grounds.
