AOS still with in my 90days

I am filling out my AOS Forms which category do i use is it A6 OR C9, ALSO is it just the I-485 and I765 that i fill out? I dont need the Advance Parole but i will do the G 1145.

I believe it is the C9 that you are looking for, File for the Ap also it does not cost you anything and will be a safe guard just in case. It can take a year to get the GC and you might need to travel in the meantime.

No, it is optional to file the I-131 for AP, but I strongly suggest you file it. The fee is waived, just like with the I-765, so why not? I have seen people think they would not need the AP, but then ended up needing it and wishing they had applied for it to begin with. Leave the date and length blank and then hand-write Unknown after you print out the form. The form is pretty easy and short for an adjustment applicant. No reason is ever needed on the form and neither is it required to provide a statement to explain your reason for wanting/needing AP.

I also strongly suggest you file the I-131 for AP. It is too easy to file for it and far too risky to not file for it. All you need to file AP are:

• I-131 form
• 2 passport size photos
• copy of your bio page from passport
• copy of your K-1 visa

That's it! And there is no fee! If you get stuck on how to fill out the I-131, use the example form as a guide.

The G-325A form is REQUIRED with your AOS application. So yes you need it.

After reading the AP instructions, since we didn't have any specific (nor urgent) travel plans,

I thought we wouldn't be qualified for AP ans was considering to leave it out,

but changed my mind at the last minute when VJ-ers recommended it to do so

regardless of any travel plans or not...

And what a good advice it was...thought I didn't provide any specific travel information,

the AP was still approved, and it's good to know that my wife has the luxury of option

to travel back to China while waiting for the GC.

So...the answer is "YES", file AP with the AOS...especially since it's free and

so that you don't regret it later.

(a )(6 ) would be used if you filed for the EAD before filing for AOS. It would cost you $380 and that EAD would not be renewable and expire when your I-94 does. It is a pointless waste of money.

You are an adjustment applicant and filing the I-765 with your I-485. You use the code for an adjustment applicant, which you can find in the instructions and the example form here, (c )(9 ). The fee for the form is waived when filed as an adjustment applicant with a pending I-485. The EAD you receive will be good for a year and can be renewed if needed. The fee to renew is also waived.
