Hi,

Rarely will the k-3 be granted. There used to be a long wait for a spousal immigrant visa and the K-3 was to elevate that wait. Since the processing for the immigrant visa is much quicker now, the K-3 has become obsolete.

You will be required to file an I-130 (for CR1/IR1 spousal immigrant visa) with the I-129 (for K-3 spousal non-immigrant visa which requires an adjustment of status). Once the I-130 is approved, the government closes the K-3.

Focus on the I-130. You will be wasting your time with the K-3.

Best of luck.

Not really worth filing a k-3 visa now a days as has been mention, it is hardly use now and there is no advantage . It might actually cause the process to take longer.

Good day. I filed for a K3 visa and it was approved. We also received an approved notice from USCIS for the IR1. The only thing to remember, for K3 visa, you still have to file for Employment Authorization (which takes up to 3 months to be processed) That costs $380. Then you have to file again for the Adjustment of Status. My wife came here late November. We filed her Employment Authorization early January. We received a NOA second week of January. Until now, we haven't received anything yet. Hoping that by next month, we will get something. My wife is starting to get impatient and bored. If you can go for the IR, do it. It will save you a lot of time and money.
