Temporary Green Card Expiring and Foreign Travel

Timeline

Hi,

My wife is travelling to Bangladesh in March and returning to USA on July 20th, however, her green card (temporary two years) is set to expires 26th August. So, she is returning before it expires. Just wanted to know if that would be any problem.

Also, Can we apply for the Removal of Conditions when she is out of the country? I mean we can prepare all the stuff and mail it 90 days before the card expires while she is outside the country to start the process. Would appreciate all of your thoughts on the matter.

Just on a side note, how long does it take to process ROC? Do they actually finish before it's time to apply for naturalization?

Just sharing My Travel experience with i751:

At Mexican POE the officers took around 10mins to check something on their system and also comforted me that this is a usual process and i don't have to worry much.

At US POE the officer took around 5mins to check something on her system and welcomed me back to USA. The process was very smooth.

Documents that i carried were: my country passport, i751 and expired GC

-----Adjustment of Status for both Parents-----------------------------------------------

05/11/2018: Mailed documents I130, I485, I131,I693, NBC for Adjustment of Status

05/16/2018: Received Date/ Priority Date - NOA Received

05/25/2018: Received NOA Bio-metrics for I485 Appt: 06/10/2018

06/10/2018: Bio-metrics are completed

06/12/2018: Received RFE requesting for a Birth Certificate for both parents

07/28/2018: Responded to RFE, sent their non availability of birth certificate copy

08/02/2018: Online status changed to " Request for Evidence was Received"

08/29/2018: Made an info pass appointment requesting for expediting Travel document as parents had to travel India. Expedite request was rejected 

09/14/2018: I131 Parole document was Approved

Nevin - your situation doesn't match the OPs, at all, based on dates of GC expiring.

1. No issue with coming back on July 20th

2. Yes you can apply 90 days before even if your wife isn't here

3. Depending on what you produce the whole ROC may take 2.5 to 4 months if there is no complication and you get everything done on time.

I'll share with you what we just did. My wife's temporary GC will expire end of March so end of December 2014 was the 90 day mark when we could send in her packet. Issue was we were traveling to Philippines for 5 weeks leaving January 10th I think it was. We didn't want to miss or have to reschedule biometrics so this is what we did. We put our packet together and signed it and sealed it in an addressed priority mail envelope and left it at home and had a family member pick it up and mail it for us 2 weeks before we got home. We had no issues with customs coming back which I don't know why anyone would if their GC is still valid or you stayed out of the country too long maybe? Our NOA1 date is 02/09/15 and we expect a biometrics letter soon. Not sure if this helps or not just what we did.

Not quite accurate. If his wife isn't here she'll need to have signed the documents before she leaves. Don't forget that!

And ROC is not taking 2.5-4 months. Please read the many various monthly threads in this forum showing that they are still processing cases from back in May/June of last year. The two service centers are working at two very different paces.
