@ Jan I think you are responding to the wrong post this

was not a misrep it was an agg felony federal case that

OP sad he was deported for...Please familiarize yourself

with the different sub sec on (212)( 6c11)

Sorry, but I was not responding to the wrong post. Your first post said an "AGG FEL (6c) ban...". I am, in fact, quite familiar with INA Section 212(a) which discusses the various ineligibilities (bans) and a 6C ineligibility of any type is NOT a ban for an aggravated felony. Criminal ineligibilites are generally under 212(a)(2) -- and money laundering, which the OP said was the crime to which he pled guilty, is 212(a)(2)(i). If by "(212)(6c11)" in this post you mean 212(a)(6)©(ii), this is an ineligibility for false claim to US citizenship -- which only has a waiver for an immigrant visa applicant if the false claim was made prior to September 30, 1996, when the law was amended to actually establish the 6©(ii) ineligibility (prior to that, a false claim to US citizenship was just included as part of 212(a)(6)© fraud and misrepresentation).

Bottom line -- this is not something the OP should try to work out on his own. His is a case where legal representation is critical if he is to have any success, IMO.

Lets hope OP contact an atty gets a free consult,

Congress law stands Lifetime bars are for CIMT

the ban carries no waivers for agg felony that

drug deaiing, money laundering cases with the feds

comes under.

So I just see this as a healthy debate ok

so what waiver you think he will be able to get

especially the fact he did not fight the case. I

am always willing to learn...show the link

Thank you so much for your thoughts here.

One lawyer told me, that there might be a way to turn my case into not aggravated felony, is that even possible?

I received no jail time and was not deported. I have no deportation papers at all, I bought my own ticket and left.

I have an appointment with Carl Shusterman later this week.

Are there any specific things I need to ask him? You guys seem pretty knowledgable, I want to come prepared with bunch of questions/options and see what he has to say.

I will post his opinion here.

I wasn't saying I thought he would be able to get a waiver...I was saying the he would not be ineligible under 6C; rather, it would be under 2A. It's important to get the correct ineligibility, since whether a waiver is available or not differs for the various ineligibilities. I agree that I don't think he has a chance at a waiver, especially given how recently he was convicted. Sorry that wasn't clear.

Jan I hear I concur....OP you have the very very most expensive & best

*Shusterman* will lay it out I suspect he will PROBABLY go the route of

vacating your sentence, so you will want to know if the state you were

charged in carries a timeline to vacate sentences, you will ask ( if the

sentence is vacated does he have a strategy to counteract FAM fact on

reason to believe even when you did no time....see USCIS states they

only look at vacated sentences where the arrest or DA made a mistake,

but not for just an individual receiving immigration benefits. Your departure

also seem recent. They'll need rehabilitation to be shown among other things

You have a good Atty dude he may even go in with a front-loaded AO

with app. but yea...he's good plus he knows lots of those ppl handling

this stuff....you keep saying you were not deported neither did time , but

you are in the same shape that someone who got put on a plane you

signed an agreement, adjudicators look at time U could have received not

only time done....I wish U well , please come back and let us know.
