CONFUSED about what to do after entering the U.S. on a K1 visa.

Hello all,

Thank you for taking the time to read this.

I am very confused on the process of getting a green card and a work permit as a K1 visa holder.

We have already filed the petition, it has been approved and it is at the NVC. We know what to do when the time comes for the interview at the consulate and all that, however, what happens next is a mystery to us.

I will be entering the US on a K1 visa in april. I need to know what to do next and I would like to be explained as if I was a five year old because whatever I read here and there doesn’t make much sense to me.

I know the first step is to get a SSN, and that I need to wait two weeks to be in the system so that I can file for it. Why is that?

what comes next? I know we must get a marriage license and obviously get married....

I don’t understant what the “adjustment of status” and “advance parole” means.

I would like to know the way for me to set the paperwork in order so that I can legally work.

I am so confused it’s frustrating. Please help me.

In terms of working, after you marry and file AOS, you can also file for AED (work permit), and you will get that 2-3 months after filing.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You need the SSN to go along with your EAD in order to work. Entering with the K-1 and marrying within 90 days makes you eligible to file for adjustment of status. Entering with the K-1 and marring a USC does not provide you any legal status in the US. You will be out of status when your I-94 expires. You file for AOS in order to become a US lawful permanent resident. Once you file, you will be in a new period of authorized stay while waiting for your green card approval.

The fees are listed here > http://www.uscis.gov/i-485

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Right, if you submit I-131 and I-765 together with your I-485.

So I assume the AOS will also get me a work permit and an advance parole for travel right?

AOS took 15 months, 2 weeks and one day.
