Visiter visa for brother who prevously was denied b4 marrige.

Hi all, i am new here and looking forword for help.

My brother 30 yr old and is just married. 3 yr back he was denied visa on the basis of not enough evidence to show ties with india. I was sponsering visit for my daughter bday. He was planned to come alone.We thought he was not able to explain. So one month later he went for another interview. He was asked about gk question like top school in india for law etc. and again denied. He is lawyer and been practicing from last 6 yr. now he is married and have a loan for building house. That house is on my mom name. I was wondering if he and his wife has any chance this time. What other things we should consider. Do any agency is for any help. We applied earlier by ourself. I am us citizen and in us from past 10 yr. i am married to us citizen.( thought to give little back ground.)

Your brother applied and was denied. Twice. The reason for those denials are the same. He cant prove he MUST return even with his legal skills.

As we see with the house seeming ties are not.

Agency? Waste of money because they can change the facts.

All he can do is apply based on the merits. I see no reason to think he will be granted a B 2 visa but Its just my opinion based on my own experiences.

Maybe if he leaves his wife behind and limits his visit to a week or two.

House in mom's name does not help.

Oh i thought they can get visa based on they are newly married and will make visiting US more sense. Kind of valid reason. Will it work if they go one at a time.

A tourist visa approval based on the applicant's merits. Having a good job in home country does not guarantee an approval. Again, he has to proof strong ties and now is up to him how to do that.

Can you please suggest what are other things that can help to prove the strong ties. I am kind of lost. Wife and kids behind. Bank balance.

Should be easy. He either has these ties and can identify them or not. If he had them before he would have been granted the visa I suppose. I nothings changed then nothing will change until the underlying facts change allowing the visa to be granted.

I think the major thing that went against him was that i was paying for his trip. We did same thing for mom dad and they get visa without any issue. He was traveling alone and was single. We didnt realize that it could be an issue. Now i am little nervous and trying to do research as much as i can b4 applying.

House is on mom name. I think property taxes are low or something if on a female name.

The reasons for visiting don't matter, what's important is the reasons for going home again at the end of the trip.

That's what he has to prove and unfortunately there isn't any list anywhere of things that can guarantee a visa.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
