Toronto v Montreal Medical w/ Care and Control Charge

Timeline

Ok, up until tonight I was not worried AT ALL about the medical for my fiance, and now I am freaking out.....

He's "older"... 45. Decent overall health but smokes and drinks.

And has a DUI from 12 years ago. We have all of his police certificates and court records, etc and I thought that would be the end of it.

Now I'm reading old posts about psychiatric evaluations and essays people had to write, and being outright declined for 'addiction'!.

We're about a month away from when our medical will be, and I just texted him that he needs to stop drinking 100% ASAP (He doesn't drink often, but every couple of weekends he will get together with friends and drink) and now I'm worried about liver levels and all of this other stuff.

Realistically. What are we looking at here? Is this still a thing, since I haven't seen a post about anything RECENTLY regarding the medicals with DUIs.

Should he go to his clinic and ask them to run a liver panel just to see what his tests are BEFORE his medical?

Should we delay his medical until closer to the interview and give him more "sober" time? Everything has gone so smoothly up until now, and now I'm terrified!

July 18, 2014: ARN Changed / USCIS check cleared my bank

September 14, 2014: Expedite requested for financial hardship; Declined for lack of evidence

October 17, 2014: He came to visit me in Atlanta for my daughter's surgery (One week together)

November 7, 2014: Expedite requested for a second time; USCIS unable to access my case for updates....

November 12, 2014: Contact my Congressman to request an inquiry into my case status

November 19, 2014: Receive notice that expedite request has been DECLINED

November 21, 2014: USCIS emailed my Congressman to inform him that the expedite has been APPROVED and will be processed.

This completely means that they re-considered their decision only after Congressional Inquiry

November 26, 2014: NOA2

November 26, 2014: Went to Toronto to Spend American Thanksgiving together (4 days together)

December 9, 2014: Shipment to NVC Notice

December 17, 2014: Received at NVC

December 18, 2014: MTL Case Number and Invoice Number Issued

December 20, 2014: Shipped from NVC to Embassy

December 21, 2014: He came for Christmas with my daughters and I (Two weeks together)

December 22, 2014: Montreal Embassy Consulate Received

This isn't very good advice.

Yes, people with DUIs have to do extra steps for the medical. You need to call the place where you're getting the medical done, and tell them that there is a DUI. They will tell you what additional things you need to do.

6 Mar 2013 -- I130 transferred to Orlando local field office (which started the whole nightmare)

Mar 2013 to October 2013 no one would tell us where our case was or what was happening. I suspected the whole time it was just sitting in a corner somewhere in the Orlando field office. I was pretty much right.

October 2013 - get congressman involved. Congressman asks USCIS repeatedly about our case but they won't even tell them anything.

31 Jan 2014- finally get NOA2!!!! (we think the nightmare is over!)

NVC

Our case was not sent from the Orlando field office as it should have been. The nightmare continues. We kept calling NVC and asking if they received our case, and they always said "NO" and that we had to wait 90 business days for it to be received. We called USCIS during this time and they kept telling us it had been sent. After the 90 days of agonizing frustration, NVC then started telling us we had to wait 120 business days. I got our congressman involved again, and they told the congressman it was sitting at the Orlando office this whole time (just as I thought it was!).

16 May 2014 -- NVC case number assigned
24 May 2014 -- AoS and IV bills paid

28 May 2014 -- Sent AoS and IV Packages

6 June 2014 -- documents scanned

18 July 2014 -- false checklist from NVC

28 July 2014 -- receive case complete email from NV

30 July 2014 -- interview booked! September 11 here I come!

Like Exocet stated, probably best he phone/email the DR he is going to and see if there is going to be any additional paperwork/procedures that need to be done, thus no surprises at the time of the medical. I recall 1 guy a few yrs back had t get a waiver..he said it was from a DUI...but who knows...1 does NOT always get the full story on VJ......Since he has a criminal record, he will need finger printing done as well.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I'd suggest for starters to not call him "older" since 45 is not "older". Those of us in our 40s offering you support and advice here certainly don't consider ourselves "older" at 45!

A couple people have suggested calling the doctor's office and find out what they want. Depending on the doctor they may or may not tell you anything before he gets there. It was like pulling teeth for me to get info from the doctor I was seeing. And I didn't have a lot of time to prepare because my interview date was only a month from my case close and the medical wasn't available immediately. I was worried about not having all the needed info while I was there and delaying everything. I was a tad on the paranoid side but my point to you is that you may need to be very persuasive on the phone with the receptionist to try to get some help before the actual medical so that you can be prepared for any special requests they will make.

I also don't think your concern at this point is the drinking and smoking. It would seem your hurdle is going to be the DUI and dealing with that specifically.

In terms of "sober time" and such, does he drink THAT much? Your post is confusing because you say he doesn't drink that much and that he goes out drinking with his friends every other weekend. That is not the same as him drinking to excess every day which would cause him to have alcohol withdrawal symptoms and other potential problems.

If you are that concerned about his drinking then perhaps the two of you need to discuss it. If he is partying every other weekend I don't think that is going to have a huge impact on his medical for these purposes. But as I said before the DUI is what you are potentially having to deal with. He may need to talk through that with the doctor in addition to you guys providing all the necessary paperwork in order to get through the interview and final approvals. I know that DUIs cause a problem but am hoping some other members can give you some more details in what to expect.

A single DUI conviction is not grounds to deny entry into the U.S; however, multiple DUI convictions or a DUI conviction in combination with other misdemeanor offenses can make a person inadmissible and require a waiver prior to entering the United States. A crime of moral turpitude (CIMT) may be grounds to deny entry to the U.S. For a list of crimes; please click here.

However as per the medical I am not sure anything else is needed if he's not an addict.

In Canada they do not routinely test for drugs or alcohol at the medical.

I only recall 1 fellow that had a DUI and he had to submit a waiver.......but pretty sure there was more to his story...more along the lines he was a very serious drinker, but not sure. He wasn't telling the whole story.......
