Travelling in the US with expired I-94 (by plane)

Hello,

I entered the U.S. on a K1 Visa, and I was wondering if I could travel within the US after my I-94 has expired but once I will have started my AOS?

Yes you can only within the USA though. Your passport and a copy of the I-787 should be your ID unless you have got a State ID. In that case, the State ID will be ok unless it has an expiry date on it

You should be fine with appropriate documentation. Not sure if your undisclosed travel plans include Texas. If you have ever been thru a TSA check point, you will notice that they have no computers. All they have is the documents you present for verification--boarding pass and ID. SInce the I-94 is now electronic, you do not have a copy of it that the CBP gave to you at your POE--you have to go to the CBP website to get a printout. So there is no way the TSA agent will know that your I-94 is expired. TSA is not vested with enforcing immigration laws that falls to the CBP. TSA is not even a real LEO as you will notice that they do not carry a firearm whereas LEOs and CBP do. There is a gentleman that takes photos of the TSA and gets into a lot of arguments that he is not allowed to do so when in fact he is. He travels by airplane regularly and just likes to confront the TSA. Be polite. Be firm. Ask for a supervisor if the first agent makes trouble for you. My wife and MIL both travelled on their passports when we travelled from Denver to NYC. My wife was waiting for her GC and my MIL was on a tourist visa. The TSA agent looked at the bio page and the boarding pass and stamped the boarding pass and off we went.

TSA is only there to make us feel safe. They have no authority about immigration matters. They have no authority to arrest you either. That is why they must call for the local LEO. They have to tell you that they are detaining you and waiting for a LEO. Even the LEO cannot enforce immigration laws unless they are like AZ or TX that have their own state laws. Immigration law is federal law and requires a federal LEO to enforce. Of course they can detain you until the proper LEO arrives. Will that happen in your case, not likely. Just have the other documentation readily available, but show your boarding pass and passport and relax.

Thank you Dave for explaining it all to me, it's true. But at my POE in Atl they had computers & put a date on the I-94 stamp in my passport telling me that past 3months I will need to regulize my status (AOS)

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, that was your POE and you were dealing with the CBP not the TSA. TSA is ony looking at your ID and boarding pass. I have not seen a computer, but I have not gone thru ATL in a very long time. They stand at a movable podium and have a stamp and a pen. Once you clear them you get in line for the strip search...er...I am to go thru security. Yes, once the I-94 expires you are out of status in the US unless you file for AOS.
