HELP! Taxes filed jointly with spouse, what to write for individual income on i-864?

Hey guys,

I'm in a pickle..

So since my husband just moved back this year to the US, he doesn't have proof of US income from the previous years that he is able to support me for the i-864 Affidavit of Support. Therefore, his brother is the joint sponsor. Now his brother is married and filed taxes jointly with his wife. Therefore, on the IRS tax transcript the total income is their HOUSEHOLD income.

On the i-864 part 6, item 13 a-c asks for last 3 years of 'MY' income. So I'm assuming that means INDIVIDUAL income? In the directions it states:

7. Item Number 14. Federal Income Tax Information.

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year.

But I don't have the brother's total INDIVIDUAL income as he filed jointly with his wife. So can I write in Part 6 item 13 a-c the total HOUSEHOLD income?

(I have an IRS transcript with the brother's individual wages and tips he received, but this is not the TOTAL income that they want me to write here..)

WHAT TO DO? Thanks for your help.

13a-c in that part is asking for what's on their tax return, so just write the total income from the brother and his wife in those boxes. My parents also filed jointly and I had them write in their household income in those boxes and then had them show their individual income (in this case, it was just spilt 50/50) on part 6 question 5 and question 6c.

It's all in the wording. ;) 13a-c asks for "My total income" and then above that for questions 5 and 6c it asks for "current individual income"

PS - if your husband's brother needs to combine his income with his wife's to meet the threshold then his wife will need to submit an I-864a "contract between sponsor and household member" to accompany her husband's I-864.

-RFE reply packet sent to Frankfurt Sept. 30, 2014

-E-mail response (NOA2) received by USCIS Frankfurt on Oct. 23, 2014 (Petition APPROVED Oct. 20!!!) :dancing:

-Paper NOA2 received in the mail Oct. 29, 2014

-Case number assigned by IV unit Oct. 30, 2014 (Received by email Nov. 3)

-Paper "Packet 3" arrived in mail Nov. 4, 2014

-DS-260 and Document Delivery Registration submitted to Frankfurt Nov. 4, 2014

-Mailed in priority date request found on Packet 3 to IV Unit Nov. 5, 2014

-IV ("Packet 3") package sent to Frankfurt Nov. 17, 2014

-Medical completed by Frankfurt panel physician Nov. 17, 2014

-Received "Packet 4" via e-mail Nov. 20, 2014

-Interview booked for Dec. 3, 2014 (booked Nov. 21, 2014 after email authorization received)
-Visa approved, issued AND picked up by the courier all within 7 hours, Dec. 3, 2014

-Visa packet had to be returned to Frankfurt for correction on Immigrant Data Summary sheet (wrong birthplace listed) Dec. 5, 2014
