Hi! Before I start my inquiries here i just want to thank you everyone here who helped me with detailed and informative facts on my K-1 visa journey especially to Hank...

And now I want to be enlightened as I dont want to have problems re entering USA using my Advance Parole as I will travel to Philippines by January 2015. My conditional greencard is still on process..I did try searching and come up with this specific questions though I know these may have been asked many times here. :) Just want peace of mind...

1.) How long am I allowed to stay in the Philippines using Advance Parole? 3 weeks, 3 months, 6 months or I could stay as long as my AP is not expired?

2.)My name on the plane ticket and my passport name should match? Passport is still in single name.

3.) Should not it be a problem or raise a red flag re entering USA even if i have AP because I filed my AOS after 6 months I arrived here? In other words I didnt file AOS right away within the 3 months.

4.) What other documents should I bring aside passport, plane ticket, EAD/AP card? I've read to bring marriage certificate but should I need another paperwork aside from EAD/AP card or is it enough?

Your answers are highly appreciated.. Thank you!

1. I'm not sure if there is a prescribed maximum period of time you can be away, but to be on the safe side, the shorter would be better. In other words, do not be away longer than what is necessary. In my personal experience, I was away for only a month to attend my sister's wedding and also for my husband and I to hold a wedding celebration of our own for the benefit of my family back home. Remember also that an AP, as USCIS would put it, is not a guarantee for re-entry to the US. Expect to be processed further at POE.

2. Plane ticket name and passport name must match.

3. On the basis of when you filed for your AOS/AP, I believe it has no bearing.

4. Bring your original marriage certificate along with your valid passport, plane ticket, and EAD-AP combo card.

By the way, please update your timeline. Thanks! :)

You could have trouble at POE if you spend too much time in the Philippines after getting married...... It will look like you came to get married left and come back to get the green card.

You emigrated to the states so you can go on vacation to your home country but not live there. I would personally say less than a month is the best.

And yes to marriage certificate copy with EAD and passport always matching the plane tickets

In other words I didnt file AOS right away within the 3 months. Normally you should have no issues entering the USA with the AP card, but CBP agents can always deny (read the small print ;) )

4.) What other documents should I bring aside passport, plane ticket, EAD/AP card? I've read to bring marriage certificate but should I need another paperwork aside from EAD/AP card or is it enough? Yes having a copy of your marriage certificate is a good thing.

The Transportation Security Administration requires that all airlines collect certain information from international and domestic travelers when making flight reservations. This information includes your full name as it appears on your passport or other government-issued identification, and which is printed onto your ticket and boarding passes. If the name on the travel documents does not match the identification you produce at the airport, you may be delayed and subject to extra security measures.

TSA

The requirements for the full-name format began in November 2010, under the TSA Secure Flight initiative, a behind-the-scenes operation that compares names on airline passenger lists with federal government no-fly lists. Passengers are also required to submit their date of birth and gender. If you do not provide the mandated information while making travel reservations, you will have to provide it at the airport, which could delay your departure.

Small Differences

If your passport has your middle name spelled out, but on your ticket it's just an initial, chances are you will not set off any TSA red flags. The agency states on its website that minor name differences between your identification and boarding pass will not affect your travel plans. If you discover insignificant name differences on your documents prior to travel, call the airline. An airline agent will electronically note your passenger record for the TSA.

Big Differences

If the ticket name and passport name have substantial differences -- such as a change due to marriage or divorce -- you will have to have corrections made by the airline or a passport acceptance facility, whichever one applies. Depending on the circumstances, the airline may make the change without a fee, or issue a new ticket and charge you the fare difference. A corrected passport will cost you reissue fees, and the processing time could extend from two to six weeks.

Bet you have your GC before April.

I received a Notice for Potential Waiver of Interview last November. I really hope I'll receive my GC before we leave, if not I'll just use my combo card.

Seems those that get the interview waiver take longer to get their GC, not sure why. I hope it arrive quickly for you.

Sir Hank, I want to ask you something. I arrived here in the US last April 2014, then filed AOS with EAd&AP on July 2014. If I go home to Philippines this April 2015, will I have problems cominh back here using AP/combo card? Read something about the 180days overstay but I didn't understand what it was hehe.

You don't have your green card yet? I would say you are on the edge of it arriving in the mail. But to answer your question if you have not received your GC yet, the AP combo card is valid for a year from issuance so no problem traveling with it back to the Phils. Yes there is some language in the USCIS website about 6 months, don't know the details.

Ah yes, the interview waiver.. always seems to delay the issuance of the GC. We had the interview, two weeks after that the card arrived, total time from filing to GC about 4 months.
