should my fiance move to another country before i file for a K1 visa for Her?

i am a 57 year old American male, my fiance is a 27 year old Philippine female. i visited her in the philippines in april of 2014 and proposed to her there as that was the reason for my visit.

i recive SSI because i am disabled for 17 years now. SSI check is bleow poverty level here and SSI is not considdered taxable income. i will need a cosponsor to qualify on the afidavit of support, and i have a cosponsor, but i have read that the co in manilla will not accept a cosponsor for a K1 under any circunstances! my fiancee works in the medical field with a BSN in nursing but not currently a nurse.

my question is this: would it be possible for my fiance gets a job in a country that is favortible towards cosponsors, for me to file for the K1 visa after she arrives in that country, and get the K1 visa approved, thus bypassing the unfavorable co in manilla? and is this the easiest route to take in our situation?

my disability is both physical and mental. i have a bad back and ADHD, that keeps me from being employed for very long at any one place.

i do aquire money threw buying items that are free after the rebate and selling them at a local auction, along with buying and selling things at the auctions, and helping a friend do some mechanic work at his place of business from time to time.

i have been thinking about the 2 of us traveling to another country and getting married there and living outside the united states for several years and then trying for a spousal visa.

as for our age diffrences, my mother is 20 years younger than my father, and i am 2 years older than one of my nieces. i have no children from previous relationships to complicate the issue. i just want to avoid wasted money and wasted time on things that will not get us closer to our dream, and is why i have filed no papers yet.

due to the economic and political climate here in america, i have no problem with our making our home permenantly in a country other than the USA.

any advise or other perspectives on our problem will be greatly appreciated. thank you!

Get married and file for the IR-1 (spousal) visa. In that case co-sponsors are allowed. 30 years age difference is a huge red flag in the eyes of USCIS, especially in a high fraud country like the Philippines. I always wondered how come that so many Filippinas end up dating American guys twice their age that could be their father.

I'll keep my opinions about your "disabilities" to myself and second the advice given by KCcouple, with the correction that it would be a CR-1 visa and not IR-1. You should also search for other threads on these forums by Philippines posters who have similar age differences, since you're not the first one in that situation.

Yes you can marry and petition her, you will need a co-sponsor

there may or may not be scrutinity due to age and disabilities,

if she lives in another country while U petition her be aware she

has to go to her home country for interview unless she legally

lives in that other country she wont be able to interview there

An age difference isn't that much of a red flag for USCIS nor for the Philippines for that matter. I also wouldn't call the Philippines a high fraud country either. The embassy at Manila is fairly laid-back and is not a difficult embassy at all to interview at.

You are incorrect about this. USEM does rarely accept co-sponsors for a K-1, but it's not true that they never accept them. It is a shot in the dark to try to get approved with a co-sponsor, but its not an impossibility. You can also marry in Philippines and file the CR-1 visa, which in this case USEM HAS to accept a co-sponsor.

Philippines is not a high fraud country?! The Philippines is a 3rd world country and is famous for the romance scams of young Filipinas trying to get with older American males. Just google it or watch a video about it on Youtube. I can tell that the Manila Embassy is very laid back, even on this site there are a bunch of couples with at least 20+ age difference and they are being approved. It's hardly believable that it's pure love.

Incorrect regarding the age difference...at least for the Philippines.

Explain how I'm incorrect. There have been several members here going through the Philippines with age differences of 20 and 30 years. I have no idea if they were ultimately successful or not, but I simply recommended that the OP consult those threads for more information.

Do I need to find the specific threads to prove you wrong?

That's a good recommendation. It might be useful if you perused the Philippine forum and with a little heavy lifting, you'll find a plethora of posts about significant age differences from the Philippines. If you'd like to find specific threads to prove me wrong...have at it. The purpose should be to help the OP.

What I can tell you is that IMO and experience, age difference isn't a huge red flag for the Philippines. At least a half dozen friends and colleagues of my wife have entered the US under various visas with a significant age difference and it wasn't an issue.

If this were posted in the Philippines forum, I'd be relatively confident that many senior members would concur.

Good luck OP.

Why not move to the Philippines? With your ssi check you can probably live like a king over there. You can also be with your girlfriend and not endure the whole immigration process.

why not move to philippines? well for a starter i would loose my monthly check and medical assistance if i move out of country and let social security know. i took a drug prescribed to me by my doctor for 8 years (respridol), during that time i contracted type 2 diabeties . my sister later informed me of a class action suit against this drug and others because of causing type 2 diabeties. after i joined the suit the lawyers droped my case because the "expert witness" refused to testify against respridol because it was "SAFER THAN THE OTHER DRUGS IN THE SUIT). now that same drug is causing adolesent boys to develop "female breasts that express milk". without medical assistance the cost of medications to fight the medical conditions caused by the drug makers would be alot more than we could afford even if she was working as a registered nurse in philippines. the condition that makes me disabled has been with me since childhood, but because i was able to be employed for small segments of time i am disqualified from regular disability payments so i would have to be dishonest to keep getting my checks while living there.

the CR1 seems to be our only choice to do this legaly.so that is how we will procede in this matter. since no paperwork has been filed yet there has been no need to publish a timeline, but i will do so soon. i would rather just bring here like they do south of the border(it would be much quicker), but she will need to be able to support herself and any children we may have, when i am no longer breathing. the age diffrence means that i am much more likely to expire before she does, and because i have never had children of my own and i am fertil, it is nice to think that we will have children if GOD wishes for us to have children. in eastern europe the younger the woman is, the larger the diffrence in the age of the man she is willing to marry, but as she ages she looks for less of a diffrence in ages.

thank you all for your advise! one more question, do you think that we should hire a professional to help with the forms so that we do not have any delays because of mistakes in paperwork? i am leaning in that direction myself!

Personally I wouldn't hire a professional, and the reason is because the forms are fairly easy to fill out and the guides here on VJ are awesome for helping you organize your petition. However, some people do choose to hire a lawyer or visa service to assist them in order to give them a sort of peace of mind. You can get all the information here to do it yourself, and even if you have doubts about certain things there are many members that can answer your questions.

Since you decided to go the CR-1 route, I would recommend reading this guide: http://www.visajourney.com/content/i130guide1

I would also take a look at this example form for the I-130 petition: http://www.visajourney.com/examples/INS-Form-I-130.pdf

Good luck with your process and if you need help with any of it don't hesitate to ask. Also, I must have missed it earlier when I replied to your post but, nice to see another Iowa filer! :)
