i was told by someone that your spouse can come here on a tourist visa and that you and the spouse get married in the u.s and then you just file for an adjustment and he can stay just wondering is this true?

Timeline

It is not true. If you are already married, then you need to file from abroad and go through the current process for IR-1/CR-1. Adjustments of status happens if you have been in the States already, you meet someone and then get married.

It is considered immigration fraud to plan to do this. People who do it that way are generally in the US on a work visa or maybe a long term tourist visa (B2 maybe?), they meet, fall in love and decide to marry in the US. It is possible. But to PLAN to do this is visa fraud...not advisable to even attempt, as it could result in a lifetime ban.

AOS can happen for a variety of reasons but what you suggest is fraud and is illegal. A person cannot intend to come to the USA and immigrate without a proper visa. They will be turned away at the border and if they lie and are found out, they can be banned from the USA for life.

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
