two joint sponsor, how to fill the forms, DS-Forms

Hi everyone,

Sorry for the long wended question :oops:

last week I got the case number from the NVC, FRN2014XXXXXX, it was assigned on Nov 12th, 2014. Today I got the Invoice ID Number.

I checked online on the NVC website, the DS forms are still not there, how long do you think they will take to be there?

I have a question regarding the joint sponsor, we have two friends that are welling to sponsor the beneficiary, an american citizen and a green card holder.

the American Citizen is married and he sponsored his wife, and the green card holder has not sponsored anyone.

in the form I-864

Part 3. Information on Immigrant(s) you are sponsoring

1. I am sponsoring the principal immigrant in part 2

( ) yes ( ) No (applicable only in cases with 2 joint sponsors)

what should we put here and if there are any recommendations?

I believe that's in cases where one joint sponsor agrees to be held responsible for one immigrant/immigrants and the second joint sponsor takes on the other(s).

-Third ESTA denied due to his suspiscious visa status on Oct. 15, 2012.
-B-2 tourist visa approved on Nov. 16, 2012!

 

(IR-1 Journey):

 

 

-Extended German residence permit obtained Aug. 23, 2014. (to qualify for DCF)

-Husband's new German passport picked up Aug. 28, 2014. (Old one expires 2015)

-I-130 packet sent to Frankfurt (DCF) Aug. 29, 2014!

-NOA1 issued Sept. 9, 2014 (received Sept.13)

-RFE regarding evidence of bona fide marriage received along with NOA1

-RFE reply packet sent to Frankfurt Sept. 30, 2014

-E-mail response (NOA2) received by USCIS Frankfurt on Oct. 23, 2014 (Petition APPROVED Oct. 20!!!) :dancing:

-Paper NOA2 received in the mail Oct. 29, 2014

-Case number assigned by IV unit Oct. 30, 2014 (Received by email Nov. 3)

-Paper "Packet 3" arrived in mail Nov. 4, 2014

-DS-260 and Document Delivery Registration submitted to Frankfurt Nov. 4, 2014

-Mailed in priority date request found on Packet 3 to IV Unit Nov. 5, 2014

-IV ("Packet 3") package sent to Frankfurt Nov. 17, 2014

-Medical completed by Frankfurt panel physician Nov. 17, 2014

-Received "Packet 4" via e-mail Nov. 20, 2014

-Interview booked for Dec. 3, 2014 (booked Nov. 21, 2014 after email authorization received)
-Visa approved, issued AND picked up by the courier all within 7 hours, Dec. 3, 2014

You cannot use more than one joint sponsor.

but my wife does not work, she is still a student and has no income at all. the joint sponsors are the main sponsors, what should we do?

Whether your wife has an income or not, she will always be the main sponsor since she's the petitioner. Everyone else would be a joint sponsor/household member of joint sponsor (to combine income using I-864a). Your wife will have to file her own I-864 either way and attach a statement to it explaining why she didn't have to pay taxes. Where it asks for the income from the last 3 years she can write "NOT REQUIRED TO FILE - NO INCOME".

Now why do people keep saying you can only use one joint sponsor when it specifically indicates on the I-864 "I am the (first)/(second) of two joint sponsors"? If I'm missing a small detail then please educate me once and for all, but people say it all the time you can't use two joint sponsors even so the form says otherwise.

You can only use one joint sponsor for IR1 because there are no family members who are derivatives. On other visa types that is allowed to break up the burden of sponsorship. However a joint sponsor can add their household members like dependent children who work or a spouse using an I-864a.

Whenever we fill out forms from the USCIS or NVC we need to remember these are multi-purpose forms for many visa types, not just spousal.

She is always the main sponsor. Then you may have one more sponsor called a joint sponsor who can add their spouse's income as the poverty guidelines are based off household income. If this one person does not make enough then someone else should be found. If you cannot do that then you'll have to wait until you can or your wife can sponsor you on her own. Edited by NLR

No. A job that you currently have and will continue after immigrating would be okay, but not a job offer.
