K1 Visa On-Hold Due to CRBA

Here's our situation:

We had our interview 2 weeks ago for K1/K2. Consul asked few questions about the petitioner and said everything looks good BUT we have to check my kid's citizenship cos his father is an USC and is on the birth certificate. I told the consul that the father never claimed my kid's citizenship and we don't have the paperwork to prove it. Nada! But she insisted that we really have to check with the ACS (at 2nd floor of USEM Manila) and wait for their advise. Cos chances are my kid won't be issued a visa but must travel on a U.S. Passport. I even asked the consul "what will happen if I can't get the documents for my son's citizenship from the biological father?", but she just shrug it off and told me to check with ACS first but re-affirmed that my visa was approved and handed me that white pamphlet with information in case I encounter any domestic violence in the US.

Long story short, I was called at window 72 for the last step and was given 2 sheets of paper the (1) 2go courier submission letter; (2) referral for citizenship determination. And I was told to go upstairs at ACS section and both our passports were returned together with my kid's NSO birth certificate.

At the ACS Section, I talked to a young Filiino guy and asked if I have any of the biological father's document a copy of his passport or birth certificate so he can set me up an appointment right away. I have none, so he handed me the CRBA checklist with instructions that I have to comply every documents listed and send everything via Air21. Before I left I asked the guy few questions - (1) what will happen if the father won't cooperate? (2) Can my kid travel with a visa instead of a U.S. Passport? (3) Is there a way that

the ACS email or mail the bio-father that they needed these documents? You can tell by this guy's reaction that he wasn't pleased at all with my questions cos he honestly doesn't know the answers to my questions and everytime he excuse himself and ask for advise from someone he'd come back looking frustrated. Before we left he handed me a sticky note with the embassy's address and contact number.

We left the embassy disappointed cos none of their staff - American or Filipino can give me a straight answers to my questions regarding my kid's CRBA.

So I decided to share with you guys our situation and maybe someone here can enlighten me of what we really need to do.

Questions:

1. Why was the guy at Window 72 returned my passport when the consul told me that I approved for K1 Visa? What's the deal?

I have other identification to submit for his CRBA so my passport won't be needed and understood I needed the BC to submit when processing the CRBA, and keep my kid's passport.

2. The biological father is not willing to cooperate to get me all the documents needed for my kid's CRBA. What will happen, will they allow my kid to travel on a K2 visa?

I don't have any copies of the bio-father's proof of identification, tax records and everything else. I've done eveything I can to contact him about these documents and reached out to his family in the US, but I got nothing. But I have all the paperwork to prove that he was here prior to conception, all itineraries, ultrasound record and pictures. I have everything ready on my end.

3. Say for example the biological father changes his mind (I'm praying for miracle to happen, but I doubt) and I got all documents needed from his end to process CRBA. Can we submit these documents and have a meeting with Consular Officer in Cebu instead of Manila? Flying to Manila from Mindanao could get really expensive. And knowing Cebu caters to walk-in applicants, no appointment needed.

1) I have no idea why he gave you your passport back if the visa needs to be stamped there, you might want to call them and ask whats going on?

2) No a US citizen (in this case your son is) will never be approved for any type of US visa, US citizen has to enter and exit the US with a US passport. It's a law.

without the required documents from the father, you can not go forward.

Well that sucks big time! Lots of delay with little possibility of completing CRBA. I was really hoping it didn't go down this path.

You will need to call the embassy (the number they gave you) and ask if everything for CRBA can be handled in Cebu.

Complete all the forms as requested, write a letter explaining everything also, so they have record of why the requested documents are missing. Once this is completed and CRBA is denied to your child, then the visa process can be completed. The embassy needs the denial for the CRBA to made it legal for them to issue the K2 visa.

The name on the BC really tossed a rock in the gears...

You can submit the CRBA in the Cebu Consular Office, but the officer in Cebu will only look it through and forward it to Manila. Based on our experience in Cebu, I would recommend going to Manila if you are in any kind of hurry, and here is why:

We submitted our son's CRBA in Cebu early September, and three weeks later I got an email from Manila Embassy asking for me to resend some papers that I had already submitted in Cebu. I immediately FedExed them in and for seven weeks there was nothing. Then I finally sent an email to Manila Embassy asking for a status update, and they responded with a recommendation that we do a DNA test. Basically it is my understanding that had we scheduled the initial appointment in Manila, we would have been talking directly with the decision maker, and if he felt we need a DNA test he would have told it to us immediately. Now using the Cebu route we experienced about 10 week delay before we even knew we need to do the DNA test.

Overall the CRBA application is only good for 90 days from the interview, so if you can not convince the officer during that time they will deny your child's citizenship. Of course, if there is no sufficient proof and no willing USC to do the DNA test, the denying decision may come much faster and you can just move on with the plan B.
