Need advice on when to start the process for K1

I was told to create a new thread in this sub-forum for more detailed information so here I am.

I'll keep it short, Have known my fiance for 2 years, Went and spent 3 weeks with her and her family in April in the Philippines. I was in China from 2011 to 2013. I left China in March 2013, I didn't start working in the US until September of 2013, so my tax return for that year only shows 4 months of income. I have been working all of 2014. According to what some of you may know about what the embassy considers, would I be best advised to start the I-129 after I get my tax return for 2014 showing a full year of employment? At my current position I make around 1k over the minimum poverty line. This is due to losing my driver's license and not being able to commute to a better position for what I went to school for. I will have my license back in a month and will then be finding work paying around twice what I make now. Any insight is appreciated!

It's REALLY difficult for us to be away from the one we love... especially once we make the decision to marry... :)

In my own opinion... it's EASIER to see a tax return or W2 form (easy proof) HOWEVER your check stubs and bank statements should/could do the same thing. I actually sent it all (tax return, W2, bank statement, letter from employer, and a summary of a year's spending that I printed from my online bank account of all my charges over $100 to reflect all my direct deposit from my job).

10/08/2015: AOS packet sent to USCIS (Chicago lockbox) via USPS Priority mail (They received it 10/10/15).

10/16/2015: Text/eEmails received from USCIS with receipt number. We received 3.

10/22/2015: Received hard copies of NOA's for I-131, I-765, & I-485.

11/01/2015: Got NOA for biometrics appt (for 11/12/15).

11/03/2015: Did WALK IN biometrics appt - took 15 mins. Person taking said work permit should be in mail in less than 4 wks.

12/09/2015: Got email/text notification for INTERVIEW date.

12/28/2015: Got email/text notification EAD card has been mailed.

12/31/2015: Received EAD/AP card.

01/11/2016: INTERVIEW (in Los Angeles office).

01/11/2016: Case in in "CONTINUANCE". Awaiting approval. (Feels like AP).

06/27/2016: I-485 APPROVED - (FINALLY!!!) / 264 DAYS (8 MONTHS 20 DAYS)

07/01/2016: GREEN CARD RECEIVED

fiance? I-134 not evaluated until interview day, so break out a calendar, and do some forecasting on your own timeline.

I have no clue what the I-134 is, don't even think that's something applicable to the K1 visa.

As Darnell said the income information isn't needed until the embassy phase of this process. So you should be fine starting the I-129F petition now.

understand the timeticks, and what's required when.

Whoaaaaa there son. Darnell is very up to date as well as Hank on the K1 visa process. I wouldn't hurry to judgment till you know more about the process. They can help you with your process but only if you remember you are the "new member" here and not them. Just my 2 centavos.

I didn't pass judgement on anyone. I'm not familiar with that form that's why I didn't know what he's talking about. Like you said, I'm new so I don't know everything about this. Simple mistake man.

Did you say you did not file taxes because you were in China? Are you aware that a US citizen is responsible to pay taxes and file a 1040 on his worldwide income?

Be that as it may, you only have to produce one year of tax returns at your fiance's interview. So if you wlll have a full year tax return say, 10 months from now, then go ahead and file now.

Darnell meant to not delay starting the petition process ONCE you have the G-325A, 2X2 passport photo (white background), Intent to Marry letter from your fiancee. (and if married before, copy of annulment finality)

Its understandable you can't file yet until you have all your documents in order, including those you need from your fiancée. But once you have all your papers in order, there's no reason to wait. You will be waiting anyways for the rest of the process until she has her visa in hand, so why add additional wait time?

Just checking, you were with her for 3 weeks last April 2013 after you left China. Correct?

No, it was this year. I flew to Manila in April, 2014 and spent 3 weeks with her.
