RFE received :s. Any help?

Hi guys: Please, forgive me for the long post but we really gonna need your help.

For the record: My husband and I got married in December, 2011. I am the US citizen and we live in Puerto Rico. We filed for ROC in April, 2014. Our journey with USCIS was smooth and easy until today. Today we are sad, we received a RFE.

They are asking for more proof of good faith marriage. One or more of the following:

- Children as a result of your of marriage - We don't have children

- Leases or mortgages in both names - No mortgage. We live together since our marriage in a property of my parents because my husband was unemployed until July, 2014. My parents sent a letter explaining we paid for food, water and electricity services but not for the house.

- Joint checking account statements for the period of your marriage - We have a joint account and we sent all the statements (2012- April/2014)

- Insurance policies - We don't have that. Is necessary?

- Joint federal and state tax returns - We sent joint tax returns (2011-2013) I was the only one working but we filed as a married couple.

- Joint utility bills - We don't have bills with both names, it can't be done here. Just one bill with one name (the phone bill). Utility bills are in my dad's name as we live in his house. We sent a letter explaining that and evidence of our bank statements showing we paid for the bills.

- Loans or credit cards - We don't have any loans and we sent joint credit cards account copies.

- A will - Is necessary? We are in our early 30's, We haven't thought of that.

- Affidavits by at least two people that have knowledge of your marital relationship - We sent five (5) affidavits with their full names, address, date and place of birth.

They listed we submitted:

- Identification documents

- Photocopies of driver's licenses

- Joint tax returns 2011, 2012 and 2013 - And why they are asking for this?

- Documents in a foreign language - Everything was translated in English. Maybe they said that because the original bills of the electricity and water services are in Spanish, we can't change that but this time I'm going to resend it with a translation. Also, I placed post-its in each page saying: "This is the electricity bill", "AEE means Energy and Electricity Authority", things like that. I can't believe they don't understand that.

- Photocopies of joint credit cards - And why they are asking for this?

- Affidavits - They are asking for more?

- Personal statements - I really don't understand why they said "personal". Is a joint bank account that show both names. Our names were highlighted in each page.

- Phone bills

- An employee information form showing your spouse as your emergency contact

- Correspondance and mail in both names

- Photographs

Documents we sent:

- Copies of driver licenses

- Joint tax returns 2011, 2012 and 2013

- Joint credit card

- Joint bank account statements (all through 2012-2014)

- A letter explaining our housing and job situation with evidences - I have a job but my spouse was unemployed, we don't paid for house because we live a property of my father.

- A certification of the residence enduring we live there and don't need to paid rent, sworn by my father.

- Affidavits

- Copy of my job contract showing my spouse as my emergency contact

- Phone bills in my spouse's name

- Joint account of our pharmacy discount card

Ok. So for now we are gathering more supporting documents as:

- Copy of my spouse job contract and stubs - Thanks God he started a job in July, 2014. (He was looking for one since 2012 but was very hard in here. We explained all in a letter we sent).

- Phone bills in my spouse name - More bills from April - November 2014

- Joint bank account statements - All again plus April - November 2014, showing my husband's income and payments of the utility bills.

- Copy of health insurance - Now that he's working, we can afford that. The same month he started his job, we got the insurance. Before, any emergency we paid in cash.

- A certification of our bank as evidence of our joint bank and credit card accounts - They don't ask for it but maybe will help.

- Correspondence in both names - More mail

- A lease for the house dated since August, 2014 - We still live in my dad's property but now we are working and we can paid for the house. My parents don't want to charge us for rent but USCIS need that, right? Is the only option I can think if they don't read the letters we sent explaining each detail. We don't going to buy a new house 'cause we don't need it.

We don't have food stamps or any government aid. I have a car but was in my name before getting married. He can't be add to the title. For now, no new car. We are studying and working for our future. For that, we aren't ready yet for children or big expenses. We live happily in that way.

Your comments and suggestions are welcome. Once again, sorry for the long post.

1. You can add joint owner to title, no matter you bought it before, just stop at DMV.

2. You don't just create a document just to satisfy USCIS (rent agreement from your parents, for examaple.) Instead, his affadavit of communal residence will be helpful, remember to notarize it to make it official.

3. Insurances, tax are the most neccessary evidences, look like you didn't send any insurances. Auto and health insurance are crucial for daily life.

Any newly opened accounts, bills will show you are trying to create evidences. And that's not good in USCIS perspective. You can't send what you haven't had and don't have so you should explain it clearly on a cover letter. The worst situation is you will have an interview, and I believe it is not that bad if you are legit. Good luck.

PS: I received RFE for same thing. We didn't have any joint banking AT ALL. We were approved after sending in all insurances, car title and registration and my father affadavit of commual residence.

2. In the case of the rent agreement, we sent an affidavit sworn by my parents explaining the situation ( wasn't notarized by a lawyer but I believe they don't read it because it wasn't enlisted in the documents they said we submitted).

3. We sent joint tax returns for the last three years but no insurances evidence. I will sent the health insurance evidence, We got the insurance the same month he found a job (July, 2014). My job doesn't offer health insurance, so always we paid in cash. From 2012 to last summer, I was the only one working. We could not afford a health insurance. This is going to be a new document because we filed for ROC in April and my spouse got a job in July.

No new opened accounts, I"ll resend all the statements for our joint banking account, plus recent statements of the same account. We are not going to create new evidence (for that I'm asking if the rent agreement is necessary). We thought that with the letter from my parents saying that we paid for utility bills (we included photocopies of utility bills in my father's and husband's name showing the same address) but not for rent was sufficient Clearly, not. We also highlighted in the bank and credit card statements for more than two years, each payment for utility bills We sent a cover letter with all the documents and specially explanatory letters for the lack: of a lease agreement, utility bills in both names and health insurance. Apparently did not read any.

We have more correspondence and pictures but they aren't asking for it. A lot of thanks for giving us hope. :)

Update: I can't add my spouse to the car title. Here, it can't be done, just one owner.

Update: I can't add my spouse to the car title. Here, it can't be done, just one owner.

Then you just explain everything on the cover letter and send in what you have, expect the worst for an interview. It is not bad at all for real relationship. Good luck.
