Hi,

What is it that you're trying to do? Are you trying to pay the fee for your uncle? Please clarify.

I see. Unfortunately, immigrating to the US isn't as simple as filling out a form and paying a fee. It's a very complicated and tiresome process. Way back in the day, like a century ago, it was possible to hop on a boat, pass some tests, fill out some forms, and you were good to go, but that is no longer the case. That said, in order for you to come to the US to immigrate, you typically need someone to petition for you.

Now you said that you have an uncle here, but unfortunately uncles cannot bring their nieces or nephews. One can only bring fiancés, spouses, children, parents, or siblings if one is a USC, and an LPR can bring unmarried children and spouses.

There are also employment visas, which I'm not too sure how they work, but I'm pretty sure you need to be petitioned by an employer and have certain skills and/or degrees. The others are asylum and refugee immigration. If you are being persecuted or fear persecution in your country, those are options, I'm just not too sure how they work either.

There is also a visa lottery, if you are a national from one of the listed countries. You can apply once a year, and I think the deadline is tomorrow, so if you are eligible apply right away. The chances of winning are very low, but it's better than not having any option.

That said, I will give you a link with the official immigration website for USCIS and for the DOS. There, you will be able to see the possible ways of immigrating to the US.

You also said that you want to be with your family, so I assume it's not just your uncle that lives here. Tell me who else of your family lives here, and I can tell you if there is a possible way to come here by a family member.

I just checked, and assuming that you are a national of Eritrea, you are eligible to apply for the diverse visa lottery, if you also meet the other requirements.

Here is the official link, do not pay a fee for someone to enter you in this lottery, it's free. Also, the deadline is on Monday, so I would read up on it right away and apply. Remember that the chances of winning are very very low, but it's better than having no other options.

Like I said, please tell me if you have other family members here so that I can tell you if they can petition you and how long it would take. And read up on the other immigration pathways as well.

I've an uncle & a cousin that they live in Detroit & also my other cousin in California. That's it. I've so many friends that they left here for good & now they're in the U.S they went as in student Visa. If I do the way they did. Can I be able to receive Green Card?

I see. The only way you can come through your uncle is by him petitioning his sibling(your mom or dad) if he's a USC, and then they would petition you after they are LPR's. It would be about 20 years before you could immigrate, which may not be an option for you.

Also please note that getting a student (or other nonimmigrant) visa with the intent to immigrate is visa fraud. That said if you want to get a student visa you have to show that you have the means to cover your expenses in the US, you have to be accepted into a school, and you have to show ties that would compel you to return home. Since you have immigrant intent, you would be denied.

A lot of people come here with student or work visas with the hopes of being sponsored by an employer at some point, which I guess could be an option if you manage to find an employer that will sponsor you once you finish your studies. If you cannot get sponsored and you are no longer a student, you would have to return home, or you will be unlawfully present in the country.

Here is info about student visas, like I said if you cannot prove to the CO that you don't have immigrant intent, you would be denied.

I wish I could tell you that there is a sure fire way, but there isn't. In order to immigrate to the US, you have to meet certain requirements/conditions. I provided you with info on possible pathways, but you have to be eligible for them.

That's about the best I or anyone else on here can really tell you. Unfortunately, you don't have a direct family member that can petition for you now, so you have to look at other pathways such as an employer sponsorship or the DV lottery.

I wish you the best of luck and who knows, you may be fortunate enough to win the DV on your first try.

You're welcome. You need to try every year, you never know. If you haven't done so for DV2016, you should do it now.
