travelling within USA

Quick question. I mean waiting on my AOS interview letter. But am leaving for vacation to Hawaii from Arizona where I live now with my husband. I know this is within the US. My question is would I just use my Canadian passport? Do you for see a year problems as I am not travelling outside the US.

That shouldn't be a problem, it's a US state, I'm going there too on honeymoon in 3 weeks Just use the passport that has your K-1 visa stamped into it, and I would bring the printed I-94 too (or at least that's what I'm doing).

Absolutely bring a copy of your marriage certificate with you. You'll probably not need to show it to any CBP agent, but you never know.

You don't need a passport to travel within the US or it's territories (Guam, US Virgin Islands, Puerto Rico). So all you would need is a drivers licence or even your Canadian passport if you wish. Any document that would let you board a plane (drivers licence is the most common).

However, all non-US citizens are supposed to carry proof of legal residency in the US (which to this date I don't think anyone ever really has or has ever had anyone even ask them for it)...

I booked the ticket in my maiden name as well as that's what is in my passport, both my Canadian and my K-1. My SSN is in my married name and we'll my marriage certificate will list my maiden name which I changed on certificate to married name. Oh my. Will this be an issue?

As TBoneTX stated, bring a certified copy of your marriage certificate. There should be no issue as long as you can prove both names belong to you.

The bolded section above is as mistaken as anything ever posted on VJ. Anyone who treats this requirement casually can get into very deep trouble. Nobody can take anything for granted during the immigration process. Federal agents who are looking to nail someone rarely have a sense of humor. We never know when we'll encounter a Federal agent.

I would also take the NOA1 for your I-485 application, assuming you don't have your EAD/AP yet. That is proof of being within a period of authorised stay, even if your I-94 has already expired. So, Canadian passport with K-1 visa, marriage certificate, copy of online I-94 and NOA1 should have you covered.

You might not get asked for any of this, but it's better to be safe than sorry. And the chances of you getting deported might be slim, but you don't want to find yourself held up for hours while the authorities try to verify that you are "legal."

Re-read what I wrote. It states, it's a requirement, however, it is not enforced. In fact Arizona was trying to create a law requiring people to carry ID as forms of lawful residency in the US and there was a huge outcry. Funny when there is already supposed to be a law that requires anyone that is not a citizen to carry proof of residency.

As I states, its' a law that isn't enforced like many others. As long as you can prove your legality is all that matters, if they even bring that into question.

All that is needed to travel within the US is a D.L. period. Carrying proof of residency is brought into question by border officials and other INS officials, not general security at US based airports for domestic travel. At least not at this point of time. This includes all US territories as well...

Good deal. Better safe than sorry. All it takes is one a-hole in the right (or wrong) position who had a bad day to ruin yours when it comes travelling.
