Visa refused, eligible for waiver

Timeline

I had my interview today at the Montreal embassy for a k1 visa. My visa was refused and I told to file for a waiver on the ground of ineligibility under section 212(a)(6)©(i) misrepresentation and 212(a)(9)(A) removal.

Can anyone help me on which from to file? Is it the I-601, the I-212 or both?

Any help would be greatly appreciated.

Consider a very experienced waiver attorney...during our waiver process this year I noticed that most of them are approved, but if you dont know what you are doing it can really slow down the process or even result in a denial.

You must make a strong case for why its an extreme hardship for your SO to relocate to Canada; and ALSO why its an extreme hardship for him/her to live in the USA without you.

You must present very strong evidence for the majority of your claims.

As you may know it must all center around the USA citizen, your hardships as a Canadian are not important to USCIS in this decision.

Not a DIY case call Lizz Cannon her first consults free

and work via phone & Skype. You will need both waivers &

should start gathering evidences, why spouse cant move to

your 1st world country with U, and why do U have to live in the USA,

petitioner needs the hardships, loans, ties to his community

job etc . doable case with attorney and good hardships but a tough

sell to an adjudicator about the use of a phony passport

Thank you guys for the guidance. I thought about getting a lawyer but decided to go it alone. My application was received on Feb 4th and Today June 10th was approved. so a bit over 4 months.

The day is getting close!!!!
