Timeline

Is there anything to be done about how unfair the difference between California and Texas processing times are? Maybe if enough people complain they'll transfer more cases? The difference is completely unacceptable.

All you can do is wait. People can complain but its isn't going to change the US govts ability to process cases.

If it is unacceptable what will you do? If you can accept the facts as they really are you may want to move to the other country at least for now. You could live there until the wait time is at a more acceptable level to you.

wow. Kinda harsh.

OP is asking a simple question and it really doesn't need that type of response.

It is a valid question imo.

OP- write an informed, detailed letter with data to back you up, to as many of our representatives as you can. Keep good records. There is not likely going to be a quick fix, but there is always hope that something will be corrected in the future.

Hi,

Maybe was a coincidence but in my experience, when I hit the month 4, happened that a lot of march, april and may filers did a lot of noise contacting their representatives and senators asking support after the delays cause the issue in the south border with illegal children, USCIS decided do a massive transfer to CSC in the last august.

My case was being processed in TSC and got transfer to CSC.

Probably you guys can do the same.

I don't think its harsh.

Its is a valid question and one that is asked many times. The reality is that there isn't anything people can do.

The response from one that you contact all these reps ect is flawed when reality is applied. You can and should contact ONE. Most of you have NEVER ever contacted any of these political operatives in your life and cant even name them without help. Still ok and should be done. Do it the right way. Do what my husband did by using their web site to inform yourself. Ask them to call you. Ask them what their voting record on immigration is. Ask them to explain their ideas for immigration reform. Ask them to contact USCIS on your behalf. Tell them about your inability to accept the situation. Demand they change it for you. Then post the results of that. That will seem harsh when reality indicates they cant do anything and wont call you at all. You will deal with some office staff trained to placate you.

Your senses are working just fine but will do you no good on this subject of immigration. The same immigration that hasn't been reformed for 60 years by these politicians or any that proceeded them. Tell them about your essential ideals. Make them explain. Then post here the results.

I am also an American now. Just as American as you. The difference is I wasnt born to it as you were. I waited and worked for it. I waited 408 days for my visa. I spent 4 years to become a citizen. During that time I worked to be ready for my test. That's reality. I my opinion what happened in my 408 days wasn't fair but it was worth every day.

You said it was unacceptable. My question remains. What are you going to because of that? If its unacceptable what exactly will you do. I learned to accept my situation I can tell you that because there was no choice that made sense.

Your choice is to face the reality or move to the UK until the case is closer to adjudication. Or I suppose you could rely on the advise that indicates you should look for cotton candy clouds and soft music to sooth your emotions.

More coincidence than anything. USCIS reviews the case loads and make adjustments as they see the need.

There are proactive steps you can take - and the reason I know this and am not just saying it for "cotton candy clouds and soothing music for my emotions"- is because I've already contacted my local and state representatives. Most are very willing to help and already in my discussions with their offices, it is clear that they are unaware of the discrepancy between TSC and CSC and are interested in helping. Just because one person had to wait months or years does not mean that you just have to accept your circumstance and do nothing about it. As I stated in another thread on this topic- we are not talking about a one or two month discrepancy- we're talking about people who are getting approved in 13 days versus 6-7 months. So can you do something? Absolutely. Find out who your local Congressmen/women are and your state senators & start making phone calls and writing letters. And continue to follow up with them. These are elected officials by the American public- part of the reason they are there is to assist tax paying citizens with situations like these. You do have rights & you have the right to assert those rights. And the other noise- just ignore it because it is not benefiting or helping anyone on this forum.

Interesting to note that these politicians you have contacted needed to told by you that there is a problem. " They were unaware " ? What does that tell you? No one ever wrote or called until you thought of doing it?

Now that you have woken the sleeping giant what exactly did they tell you they were going to do and when will it be done?

Please make specific reference to these 13 day approvals you speak of.

These unaware politicians that you helped elect yet cant name are now moving at light speed to solve your case problems?

Please explain what our rights are when it comes to these immigration matters. That would help many people understand the true benefit of your recent advise. Your case can become the new poster child for what others should do. Sort of Gandhi of V J.

I was thinking the same thing. Ning, there is definitely no need to be as nasty as you are being. People are far from their loved ones, and they want to close that gap. They do not want to feel helpless and just wait. There is always something that can be done, if for nothing else, then to have a purpose or feeling like youre doing something. With regards to 'our rights when it comes to immigration matters', we have the right to atleast ask our government to do something, say, the transfer of petitions to even the load, thus reducing the variance of wait time each person goes through, making things more 'fair'. (Freedom of petition, but im sure you already know about that, since you seem like you are very involved with politics and government ) Why should a person who filed a petition 6+ months ago be in the 'initial review' stage, while another person who just sent it off this month receive a NOA2 already? Im happy for them that they got it so early, but im also saddened for those that have waited for so much longer. When youre in that position, you cant help but to feel cheated. Anyways, without telling them, and showing them enough people care about a particular issue, how would government officials and the people whos salary comes from our tax dollars (and thus are working for US) know to tackle that issue?

The 13-day approval might have been a newly received petition that was grabbed as a training exercise for a new adjudicator. This happens.

There are rumors that the service centers might (from time to time) process some recently received petitions first, to get their "speed-of-processing numbers" to look better. Even corporate departments do similar things.

When the VSC was processing I-129F petitions, it was verified that the VSC would shift its workload focus from one petition type to another, depending on backlog. It's possible that the CSC and the TSC are operating similarly.

The variance of helpfulness among elected officials -- Congressmen and U.S. (not "state") senators -- is as wide as the population of VJ is. Some place a priority on assisting constituents with immigration matters, and some blow their constituents off. During my time of agony, a now-former Congressman's immigration staffer treated me as though I were the only constituent in the world. Conversely, the very top aide to a blessedly former U.S. Senator (whom I'd tried for 2 solid days to reach) cut me off in mid-first sentence and said, "The Senator has far more important things to do than to concern herself with one person's K-1 matters." Thank you very much.

As I recall, my I-129F petition was among the last, or was THE very last, to be processed in my monthly group. A kindly Immigration Officer tracked down where it had been misplaced on the CSC processing floor, and he helped to get it moved to where it next had to go. This was when the CSC was processing at the speed of molasses and the VSC was whipping approvals out in a matter of weeks.

The abovementioned Congressman's aide remarked to me, "USCIS is our very worst [Federal agency]." However, this initial experience with USCIS was nothing when compared with the hellhole horrors of the consular stage. These many years later, I'm still actively steamed and would (figuratively) take scalps if they could be found. I would be joined in the endeavor by at least a half-dozen other VJ petitioners of my era.

This entire process is not rapid, not pleasant, and not easy except in the rarest of instances. If Mrs. T-B. were to turn out not to be my final wife, I would rather die alone than repeat this process.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
