Can my spouse/petitioner recent felony charges affect my N400?

Hello VJ Family!

I'm just trying to put my mind at rest here. I filled N400 last month 09/18/14 and got my NOA dated 09/24/2014 which was the last correspondent i got. Still no biometric appointment letter yet! I think i should have it by now, or hopefully by the end of this week, as it would be well over 30days by then.

Brief Details:

Last November, my wife was arrested for recieving stolen property from a previous job she worked with for 4years. she was arrested from her then new job, spent a night in jail and i bonded her out for $500 the next day. This almost broke us apart. She appoligized and explain what happened,how it happened and that it happened before we met and got married and she did it to keep a roof on her and my step son's head. Apparently it took the detectives that long to gathether their facts. When she came clean to me and told me the time she commited the crime, to the day she was arrested, it was 2years and 13days. Long story short, i felt for her. She's my wife, She's remourseful about it, so i hired her an attorney who took up her case and went to court with her for almost 8months. The case was over in August. She was put on 2year probabtion, community service because she pleaded guilty and the lawyer reach that deal with judge and procector on last day in court. However she still have the felony on her record. No day pass by without her regretting what she did.

On my part, no traffic ticket/violations. My record is clean. I am still married to her, she filled my I-1130, I-485 almost 3 years ago.

I check my status online today, it's still on initial review and it states in the sub-section that :

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

My questions are:

Would this affect my N400 in anyway? Would this be brought up during my interview? If yes, what documentation would you suggest i take just incase. Would this delay my N4oo process? Just want to know.

I wouldn't worry about it. Have you commited a crime? If no, then what she did shouldn't affect you unless the police thinks you were part of it, which doesn't seem like it. If anything, I would get a notarized statement from your wife saying that it all happened before you met and that you had no knowledge of the facts until her arrest.

Also, where is your Field Office? That can affect how quickly you get your biometrics appointment letter. Try to find other filers from your area to see how it progressed with them.

Thank you alix for you reply. I pretty much felt the rule of thumb should apply "Whoever do the crime, pays for it" I was just stunned upon reading the initial review sub-section about initaiting background check on both of us. We are actually a state apart. My local office is Indianapolis.

I may be wrong but I think the language in that subsection is generic, used in many cases. In the case of N400, there is no "petitioner" per se. You are the applicant, and you are applying for yourself although her signature is on the application. I wouldn't worry too much about it.

Filing based on 3yrs/USC Spouse. 3 year residency anniversary is in August 2014. Filed immediately after the 90-day early filing mark (May 2014)

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014
